did not request services but a fire or other situation exists which, at the discretion of the fire department personnel in charge requires fire service, the party will be charged and billed. All parties will be billed whether or not the fire service is covered by insurance. Any billable amount of the fire charge not covered by a party’s insurance remains a debt of the party receiving the fire service.

(B) Parties billed for fire service will have 30 days to pay. If the fire service charge is not paid by that time, it will be considered delinquent and the City will send a notice of delinquency.

(C) If the fire service charge remains unpaid for 30 days after this notice of delinquency is sent, the City will use all practical and reasonable legal means to collect the fire service charge. The party receiving fire service shall be liable for all collection costs incurred by the City including, but not limited to, reasonable attorney fees and court costs.

(D) If the fire service charge remains unpaid for 30 days after the notice of delinquency is sent, the City Council may also, on or before October 15 of each year, certify the unpaid fire service charge to the county auditor in which the recipient of the services owns real property for collection with taxes. The county auditor is responsible for remitting to the city all charges collected on behalf of the city. The City must give the property owner notice of its intent to certify the unpaid fire service charge by September 15.

(E) False alarms will be billed as a fire call after the first call to the property within the calendar year.

SECTION SIX: MUTUAL AID AGREEMENT

When the City fire department provides fire service to another fire department pursuant to a Mutual Aid Agreement, the billing will be determined by the Mutual Aid Agreement.

SECTION SEVEN: BILLING PROCEDURE FOR FIRE PROTECTION CONTRACTS WITH TOWNS OR OTHER CITIES

When the City fire department provides fire service to another city, town, or fire department pursuant to a Fire Protection Contract, the billing will be determined by the Contract.

SECTION EIGHT: APPLICATION OF COLLECTIONS TO BUDGET

All collected fire charges will be city funds and used to offset the expenses of the City fire department in providing fire services.

SECTION NINE: EFFECTIVE DATE

The ordinance shall become effective upon its passage and publication according to law.

MAY 19, 2009

1. Commissioners Erichsrud, Groskreutz, Loveall, Roper and Warmka were present. The pledge of allegiance was recited.

2. Approved synopsis and official proceedings of May 5, 2009.

3. Approved agenda of May 19, 2009.

4. Approved hiring Richard Johnson of Frost as an intermittent bus driver effective June 1, 2009.

5. Approved hiring a part-time clerk/typist in the County Attorney for up to 14 hours per week.

6. Authorized purchase of rock, edge bullets, plastics, sod, and other items necessary for landscaping at the lowest cost.

7. Authorized up to $5,000 for incidental items at the law enforcement center.

8. Adopted Resolution 09-CB-10 naming the County of Faribault as legal sponsor for a snowmobile trails maintenance grant. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

9. Accepted bid of $923,527.70 from Borneke Construction Inc. of Janesville for SAP 22-631-009. Other bids were received from Mathiowetz Construction for $936,909.95, Brunz Construction, Co. for $978,699.39, Midwest Contracting, LLC for $1,061,288.04, Sorenson Brothers for $1,078,573.41, Griffin Construction Co., Inc. for $1,133,130.88, and Freeborn Construction for $1,615,108.86.

10. Approved request from N. Haas to attend a three-day Victim Witness conference in Brainerd; from D. Leland to attend a one-day DOC office admin specialist training seminar.

11. Approved Resolution 09-CB-11 to sell $360,000 in bonds for the Huntley sewer system. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

12. Authorized Auditor/ Treasurer/Coordinator to obtain bids on the water softener system at the law enforcement center from prior bidders on the system with a correction on the bid of no requirement of brass valves and to allow a two or three tank system.

13. Approved Resolution 09-CB-12 amending the 2009 budget. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

14. Approved payment of bills totaling $474,702.47.

Discussion was held concerning the following:

1. B. Ripley met regarding personnel business.

2. M. Gormley met regarding sheriff business.

3. M. Stindtman met regarding soil and water business.

4. J. McDonald met regarding public works business.

JUNE 2, 2009

1. All commissioners were present. The pledge of allegiance was recited.

2. Approved synopsis and official proceedings of the May 19, 2009 regular meeting .

3. Approved agenda of June 2, 2009.

4. Approved a memorandum of understanding with Martin County and Jackson County in the establishment of Faribault, Martin and Jackson County family dependency treatment court with grant funding.

5. Approved advertising for a bid letting on July 15, 2009 at 11:00 a.m. to crush 100,000 tons of gravel at the Baker Pit.

6. Approved partnering with Martin County on a road striping contract, with Martin County taking bids July 2, 2009 at 11:00 a.m.

7. Approved an SSTS loan to Dean and Tracy Warmka of $13,185.95 on Parcel No. 03.020.1001 in Brush Creek Township. Commissioner Warmka abstained.

8. Approved a contract with the Minnesota Department of Corrections to be fiscal agent for the adult probation secretary position from July 1, 2009 until June 30, 2010.

9. Adopted Resolution 09-CB-12 correcting a resolution passed at the April 7, 2009 meeting for the purchase of a transit bus. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

10. Adopted Resolution 09-CB-13 approving a joint powers agreement for South Central Workforce Council with the counties of Blue Earth, Brown, Faribault, Le Sueur, Martin, Nicollet, Sibley, Waseca, and Watonwan. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

11. Approved an abatement of taxes payable in 2008 of $372 to Minnesota Department of Natural Resources on Parcel No. 20-021-0300 in Winnebago Township and an increase of taxes payable in 2009 of $418 to Thomas and Bonnie Miller on Parcel No. 02-005-0500 in Blue Earth Township.

12. Accepted low quote of $22,695 from Culligan Water Conditioning, Inc. of Fairmont for a water softener system at the law enforcement center. One other quote that met the specifications was received from Coxworth Water Conditioning of Blue Earth for $30,450. Quotes were received from Tonna Mechanical, Inc. for $13,700 and $17,500 but did not meet the specifications. Commissioners Erichsrud and Roper voted no.

13. Approved payment of bills totaling $89,728.06.

Discussion was held concerning the following:

1. Beverly Snow met regarding drug court business.

2. J. McDonald met regarding public works business.

3. L. Krosch met regarding treasurer’s office business.
