The principals all gave reports to the board.

Action Items:

On a Becker/Eckhardt motion, the board approved the Indoor Quality Management plan and the Health and Safety policy as presented by Superintendent Brandsoy. Unanimous approval.

On an Becker/Haugh motion, the board approved Capital Outlay and Deferred Maintenance Budgets for 2010-2011. Unanimous approval.

Member Cahill introduced the following resolution and moved its adoption: Resolution to Discontinue/Reduce the following educational programs and/or positions: Grade Kindergarten: 1 FTE, Music: .40 FTE, Special Ed: .50 FTE, Tech Ed: .50 FTE. The motion for the adoption of the foregoing resolution was duly seconded by Member Hanson and upon vote being taken thereon, the following voted in favor thereof-Bly, Cahill, Haugh, Hanson, Eckhardt, Fellows, Becker. The following voted against: none. Whereupon said resolution was declared duly passed and adopted.

Member Haugh introduced the following resolution and moved its adoption: Resolution relating to unrequested leave of absence of the teaching contract for Alicia Corbett: .40 FTE, effective at the end of the 2009-2010 school year, pursuant Minnesota Statutes, Section 122.40, subdivision 11. The motion for the adoption of the foregoing resolution was duly seconded by Member Cahill and upon vote being taken thereon, the following voted in favor thereof-Bly, Cahill, Haugh, Hanson, Eckhardt, Fellows, Becker. The following voted against: none. Whereupon said resolution was declared duly passed and adopted.

On a Eckhardt/Fellows motion the board approved the resignations of Margaret Germain and Janet Nelson from Adult Basic Education and Kristin Burk as the Gifted and Talented Coordinator. Unanimous approval.

On a Becker/Hanson motion the board approved leave requests from Kimberly Slette Unanimous approval.

On a Eckhardt/Fellows motion the board approved the retirements of Gary Engler: High School Tech Ed and Steve Frederickson: High School Social Studies (November 12, 2010) Unanimous approval.

On a Haugh/Becker motion the board approved contract non-renewals for Ellen Armburst: Elementary Special Education and Kristin Burk: Elementary Title I. Unanimous approval.

On a Cahill/Eckhardt motion, the board adjourned at 7:16 p.m. Unanimous approval.

NOTICE OF MORTGAGE

FORECLOSURE SALE

THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTIFICATION OF THE ORIGINAL CREDITOR WITHIN THE TIME PERIOD PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.

NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of the mortgage dated March 6, 2000, executed by Janet R. Spencer and Timothy J. Spencer, Married as Wife and Husband, as mortgagors, to TCF National Bank, a national banking association, as mortgagee, recorded in the office of the County Recorder of Faribault County, Minnesota, on April 4, 2000, as Document No. 307571, which mortgage conveyed and mortgaged the following described property, situated in the County of Faribault and State of Minnesota 56013, and tax identification number 210180160:

A tract commencing at the North East corner of the South Half of the Northeast Quarter of Section Eighteen (18), Township One Hundred Two (102), Range Twenty-Seven (27) in Faribault County, Minnesota; and running thence West 208-7/10th feet, thence South 280-7/10th feet, thence East 208-7/10th feet, and thence North 208-7/10th feet to the point of beginning.

All that part of vacated West Street in the City of Blue Earth, Faribault County, Minnesota described as follows: Commencing at the Southwest corner of Block 43 of the City of Blue Earth; thence South 88 degrees 38 minutes 30 seconds West (assumed bearing) along the Westerly extension of the South line of Block 43 a distance of 10.57’ to the point of beginning; thence North 0 degrees 28 minutes 51 seconds West a distance of 114.17’ to a line lying parallel with and 268.00 feet South of the South line of Block 42; thence South 88 degrees 34 minutes 04 seconds West parallel with the South line of Block 42 a distance of 13.00’ to the East line of the Southeast Quarter Northeast Quarter of Section 18, Township 102, Range 27; thence South 1 degree 00 minutes 26 seconds East along the East line of the Southeast Quarter Northeast Quarter a distance of 114.14’ to the Westerly extension of the South line of Block 43; thence North 88 degrees 38 minutes 30 seconds E along said Westerly extension of the South line of Block 43 a distance of 11.95 feet to the point of beginning.

That the original principal amount secured by said mortgage was $78,134.53; that there has been compliance with any condition precedent to acceleration of the debt secured by said mortgage and foreclosure of said mortgage required by said mortgage, any note secured thereby, or any statute; that no action or proceeding has been instituted at law to recover the debt remaining secured by said mortgage, or any part thereof; that there is claimed to be due upon said mortgage and is due thereon at the date of this notice, the sum of $67,626.38 in principal and interest.

That by virtue of the power of sale contained in said mortgage, the said mortgage will be foreclosed by the sale of the above described premises with appurtenances, which said sale will be made by the Sheriff of Faribault County, Minnesota, at the Sheriff’s main office 320 Dr. H. Russ Street, Blue Earth, Minnesota, on June 16, 2010, at 10:00 o’clock a.m., at public auction to the highest bidder, to pay the amount then due on said mortgage, together with the costs of foreclosure, including attorneys’ fees as allowed by law, in accordance with the provisions of said mortgage. The time allowed by law for redemption by the mortgagors, their personal representatives or assigns, is six (6) months from the date of said sale. THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR’S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 528.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.

If the mortgage is not reinstated under Minn. Stat. 580.30 or redeemed under Minn. Stat. 580.23, the mortgagor must vacate the mortgaged property by 11:59 p.m. on December 16, 2010.
