NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of the mortgage dated March 6, 2000, executed by Janet R. Spencer and Timothy J. That the original principal amount secured by said mortgage was $78,134.53; that there has been compliance with any condition precedent to acceleration of the debt secured by said mortgage and foreclosure of said mortgage required by said mortgage, any note secured thereby, or any statute; that no action or proceeding has been instituted at law to recover the debt remaining secured by said mortgage, or any part thereof; that there is claimed to be due upon said mortgage and is due thereon at the date of this notice, the sum of $68,156.01 in principal and interest.

AN ORDINANCE FOR THE CONVEYANCE OF REAL PROPERTY

OWNED BY THE CITY OF BLUE EARTH

The City of Blue Earth does resolve as follows:

SECTION I

The City of Blue Earth owns certain property located in the City of Blue Earth, Faribault County, Minnesota legally described as follows:

Legal description attached hereto as Exhibit “A.”

SECTION II

BPR Investments, L.L.C. is desirous of purchasing property in Section I above and the City of Blue Earth is desirous of selling such property for a sale price of $500,000.00.

SECTION III

Pursuant to the provisions of Minnesota Statutes '412.211, the City of Blue Earth is hereby authorized to sell and the Mayor and City Administrator are hereby authorized to convey the property described in Section I of this Ordinance to the purchaser upon payment of the purchase price.
