ORDINANCE NO 10-08
AN ORDINANCE FOR THE REGULATION OF
NATURAL AND GROUND WATER DRAINAGE AND
ESTABLISHING AN INFLOW/INFILTRATION
SURCHARGE AND PENALTY RELATING TO
NON COMPLIANCE/
NON-CONFORMANCE
WHEREAS, the City of Blue Earth recognizes that unchecked Inflow/Infiltration (I/I) into the sanitary sewer system creates unnecessary usage and expense in the Wastewater Treatment Plant; and
WHEREAS, in an effort to reduce I/I, the City has initiated an inspection program to identify the non-complying properties; and
WHEREAS, as an incentive for property owners to take the necessary steps to bring their property into compliance within a reasonable time, the City of Blue Earth will impose a surcharge on properties not in compliance with I/I regulation after January 1, 2011; and
WHEREAS, in an effort to reduce I/I in as many properties as possible, as quickly as possible, the City of Blue Earth will require that compliance or non-compliance be disclosed and verified during any transfer of ownership of the property and before a building permit will be issued for the property.
NOW THEREFORE BE IT ORDAINED by the City Council of the City of Blue Earth that Subsection 720.02, Subd. 3 of the Blue Earth City Code be and hereby is amended as follows:
Subsection 720.02, Subd. 3 – Unlawful Acts and Penalties, Natural/Ground Water Infiltration and Inflow.
A. It is unlawful for any person to make or maintain a connection between eaves troughs, rainspouts, footing drains, or any other conductor used to carry natural precipitation or ground water, and the sanitary sewer system or any part thereof.
B. Any property owner in violation of this Subdivision and upon receiving notice of said violation, shall disconnect the conductor from the sanitary sewer system by the end of the year in which the property owner is notified of the violation. Any property owner in violation of this Subdivision after January 1, 2011 shall be assessed a monthly surcharge, the amount of which will be established by Resolution of the City Council, for each month that the conductor is not permanently disconnected. Failure to permanently disconnect the conductor, or reconnection of a disconnected conductor may result in the suspension of water and sanitary sewer service.
C. It is unlawful to discharge stormwater or any other unpolluted drainage anywhere other than a specifically designed storm sewer or a natural outlet approved by the City and other regulatory agencies.
D. Any property found where a reconnection of a disconnected I/I conductor has occurred shall be assessed a surcharge in an amount set by resolution of the City Council per month. The surcharge shall be calculated from the date of inspection and approval until disconnection has been reestablished. Failure to permanently disconnect the conductor shall result in the suspension of water and sanitary service.
E. Any property in violation of this Subdivision shall be a petty misdemeanor punishable by a $300.00 fine in addition to the surcharges specified in subparts B and D above herein.
This ordinance shall become effective thirty (30) days after publication of notice of its adoption.
This ordinance was adopted by the Blue Earth City Council on this 4th day of October, 2010.

AN ORDINANCE TO CONVEY REAL PROPERTY
The City Council of the City of Blue Earth do ordain as follows:
SECTION I
The City of Blue Earth owns certain real property located in the City of Blue Earth, Faribault County, Minnesota legally described as follows:
A tract of land in the Southwest Quarter of the Southeast Quarter of Section 17, Township 102 North, Range 27 West, in the City of Blue Earth, Faribault County, Minnesota, described as follows:
Commencing at the southeast corner of Block Sixteen, Garretson’s Addition to Blue Earth City (now City of Blue Earth), Faribault County, Minnesota according to the recorded plat thereof on file and of record in the Office of the County Recorder; thence South, along the southerly extension of the east line of said Block Sixteen, a distance of 618 feet; thence West, parallel with the south line of said Block Sixteen, a distance of 150 feet to the point of beginning; thence South, parallel with the southerly extension of the east line of said Block Sixteen, a distance of 61.86 feet; thence West, parallel with the south line of said Block 16, a distance of 152 feet, more or less, to the east right-of-way line of Gorman Street (as said street is currently monumented and laid out); thence North, along said east right-of-way line a distance of 61.86 feet, more or less, to a point on a line lying parallel with the south line of said Block 16 and passing through the point of beginning; thence East, parallel with the south line of said Block 16, a distance of 152 feet, more or less to the point of beginning.
SECTION II
Mindy Nagel is desirous of obtaining said property described in Section I above herein and the City of Blue Earth is desirous of transferring said real property for valuable consideration, receipt of which is hereby acknowledged.
SECTION III
Pursuant to the provisions of Minnesota Statutes §412.211, the City of Blue Earth is hereby authorized to transfer and the Mayor and City Administrator are hereby authorized to convey the real property described above in Section I herein of this Ordinance to the purchaser upon receipt of the consideration therefore.
SECTION IV.
This Ordinance shall not be effective until thirty (30) days after its passage and publication.

AUTHORIZING FULL AND
PARTIAL PRE-PAYMENT OF SPECIAL ASSESSMENTS BY AFFECTED PROPERTY
OWNERS WITHIN THE CITY OF BLUE EARTH
The City Council of the City of Blue Earth does ordain as follows:
SECTION I.
That a new Subdivision 5 to Subsection 800.02 of the City Code is hereby created and added to the City Code which states the following:
(800.02) Subd. 5. Special Assessments and Payment. In the event any portion of the cost of construction or repair of any roadway surface, sidewalk or curb and gutter upon any public property is to be defrayed by special assessment, the procedure prescribed in Minnesota Statutes Chapter 429, as amended, shall be followed. Any abutting or affected property owner shall be allowed to make either full or partial pre-payment to the City for said special assessments as authorized by Minnesota Statutes §429.061 as amended.
SECTION II.
This Ordinance shall become effective upon its passage and publication.
