The Joint County Authority Board of Commissioners acting as the Joint County Drainage Authority will be meeting Wednesday, November 10, 2010 at 1:00 P.M., at the Truman Community Building, 313 N. 1st Ave, Truman, MN. The purpose of this meeting is to accept the Viewer’s Final Redetermination report on the above drainage systems.

It is Ordered and Notice is given that on November 16, 2010, at 10:30 a.m., a hearing will be held in this Court at Blue Earth, Minnesota, for the formal probate of an instrument purporting to be the will of Decedent, dated October 25, 1994, and codicil to the will dated 2/10/1998 and 4/17/2005, and for the appointment of Esther E. Hanson whose address is: 1575 Hoover Drive #21, North Mankato, MN 56003-2671 as personal representative of the Estate of the Decedent in an Unsupervised administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the personal representative will be appointed with full power to administer the Estate, including the power to collect all assets, pay all legal debts, claims, taxes and expenses, to sell real and personal property, and do all necessary acts for the Estate.

Notice is also given that (subject to Minn. 524.3-801) all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

Wasgatt, Lark Reynolds, Ellen A. Black, H.D. Paschke, Peter Weber, Archie Braastad, Joe Sullivan, Alma Sullivan, G.M. Bernards, R.K. Hertel, W.E. Hertel, Henry B. Paulsen, Donald Ficken, Illa Jean Ficken, Roger T. Peterson, Dianne J. Peterson, and also the unknown heirs of the named Defendants, and all other persons unknown claiming any right, title, estate, interest or lien in the real estate described in the Complaint herein,

THIS SUMMONS IS DIRECTED TO DEFENDANTS ABOVE NAMED:

1. YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is on file in the office of the court administrator of the above named court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this summons.

2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this summons located at:

3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not Answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the complaint. If you do not want to contest the claims stated in the complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the complaint.

5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.

6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.

7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in Faribault County, State of Minnesota, legally described as follows:

A tract of land in the Southwest Quarter of the Southeast Quarter of Section 17, Township 102 North, Range 27 West, in the City of Blue Earth, Faribault County, Minnesota, described as follows:

Commencing at the the southeast corner of Block Sixteen, Garretson’s Addition to Blue Earth City (now City of Blue Earth), Faribault County, Minnesota according to the recorded plat thereof on file and of record in the Office of the County Recorder; thence South, along the southerly extension of the east line of said Block Sixteen, a distance of 618 feet; thence West, parallel with the south line of said Block Sixteen, a distance of 150 feet ot the point of beginning; thence South, parallel with the southerly extension of the east line of said Block Sixteen, a distance of 61.86 feet; thence West, parallel with the south line of said Block 16, a distance of 152 feet, more or less, to the east right-of-way line of Gorman Street (as said street is currently monumented and laid out); thence North, along said east right-of-way line a distance of 61.86 feet, more or less, to a point on a line lying parallel with the south line of said Block 16 and passing through the point of beginning; thence East, parallel with the south line of said Block 16, a distance of 152 feet, more or less to the point of beginning.

The object of this action is Quiet Title Action.

PUBLIC ACCURACY TEST

Notice is hereby given that a public accuracy test of voting machines and ballots for Faribault County will occur on Friday, Oct. 25, 2010 beginning at 8:30 a.m. in the Board Room of the Faribault County Courthouse, 415 North Main, Blue Earth, MN. A precinct from each congressional, legislative, county commissioner, city and school district will be tested.

The public is invited to attend.
