PROJECT DESCRIPTION:

Complete Mechanical system modification and indoor air quality improvements. Installation of new hot water boiler plant, roof top air handling units, interior air handling units, duct distribution, mechanical piping, DDC controls, new fire sprinkler system and associated general construction such as demolition, acoustical ceilings and gypsum assemblies. Project will be completed over two separate summers of 2012 and 2013.

BID DATE AND LOCATION:

Sealed bids will be received at Blue Earth Area Schools, 315 E. 6th Street, Blue Earth, MN 56013, then publicly opened and read aloud. Bids will be received and stamped-in prior to 2 PM local time, on March 20, 2012.

BIDDING REQUIREMENTS:

Each bidder must comply with the following requirements to reassure acknowledgment recognition of their bids:

Bids must be accompanied by bid security in form of certified check, cashier's check, or bid bond in amount of 5% of base bid submitted, made payable to owner, as guarantee that bidder will, if awarded, enter into contract in accordance with contract documents and submitted bid.

Submit bid in duplicate on the prescribed form, which is furnished with the specification, with full name and address of the bidder.

Completely fill in all blank spaces on the Bid Form, in ink or typewriter, in both words and figures.

Sign in longhand, executed by a principal duly authorized to enter into an agreement. If a bidder is a co-partnership, then signatures on the bid shall be by an authorized member of the firm, with names and addresses of each member of partnership.

Base bid and all alternate bids shall be stated both in writing and in figures. In all cases, written and numerical figures must agree; otherwise at Owner's option, it shall be cause for rejection of bid. Complete form without alteration.

Submit alternate prices (bid) for either increasing or decreasing the cost as called for on bid form and Description of Alternates. Submit a bid for all alternates.

Owner may make such investigations as he deems necessary to determine the ability and responsibility of the bidder to perform the work, and any bidder shall furnish to Owner all such information and data for this purpose, as the Owner may request. Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the Owner that such bidder is properly qualified to carry out the obligations of the contract and to complete the Work contemplated therein. The competence and responsibility of bidder will be considered in making an award, including, but not limited to: (1) proof of financial responsibility, (2) quality of similar work, (3) amount of experience with similar projects, (4) facilities, personnel and equipment, (5) reputation for performance, and (6) ability to complete the work within specified time. Owner reserves the right to reject any Bid where there is reasonable doubt as to the qualifications of the bidder.

Owner reserves the right to (1) accept bidder's Base Bid only, (2) accept any one or more of bidder's Alternate Bids, in any order regardless of the order in which they were listed, (3) reject all Bids, (4) award contract based on his investigation of bidders, as well as acceptance of alternates, all of which Owner deems to be in his best interest, (5) waive informalities or minor irregularities in bids and waive minor irregularities or discrepancies in bidding procedure.

Upon award of Contract, Contractor shall provide AIA A312 Performance and Payment Bonds in the amount of 100% of Contract Sum in accordance with General Conditions and Amendments to General Conditions.

BIDDING DOCUMENTS & SITE REVIEW:

Each bidder (including subcontract bidder where appropriate) is responsible to visit the site and to fully inform himself and record his own investigations as to the extent of the Work, the extent of the work performed by other contractors under other construction packages, conditions under which the Work is to be performed, existing buildings and streets, conditions of the area, existing utilities and other features, type of soil, available facilities and difficulties that may be encountered in connection therewith, and other relevant items which will affect his bid or the Work.

Prior to submitting a bid, each bidder is required to examine all of the bidding requirements, all Contract Documents, all drawings and specifications for the Project (including those primarily for other Subcontracts), become thoroughly familiar with the scope of the Project and all factors and items of work which will affect his bid or the Work, whether shown or specified in documents primarily for Work of others or Work of this Contract.

No extras will be allowed the Contractor as a result of misunderstanding of the extent of scope of the Work as a result of his failure to study and record his own findings. Submission of a bid shall be proof that such examinations have been made and that bidder has recorded his own investigation and has become thoroughly familiar with all contract documents (including all addenda). The failure or omissions of any bidder to examine any form, instrument or document shall in no way relieve any bidder from any obligation in respect to his bid.

PRE-BID CONFERENCE:

A pre-bid conference will be held at Blue Earth Area Elementary and Middle School on March 8, 2012 at 2:30pm. Bidders are responsible for attending and familiarizing themselves with all site conditions. No extras will be allowed because of the bidder's misinterpretation to the amount of work involved, bidder's own error, negligence, or failure to examine the site.

START DATE:

Work may begin after receipt of the signed contract from Blue Earth Area Schools. Pre-construction and submittals work related to the project is to commence immediately after receipt of the signed contract. The work on the premise is anticipated to begin as weather and building availability is determined, no later than June 4, 2012 for phase 1 and June 10, 2013 for phase 2.

SUBSTANTIAL AND COMPLETION DATE:

Owner requires work to be substantially complete on or before August 10, 2012 for phase 1 and August 9, 2013 for phase 2 and fully complete on or before August 17, 2012 for phase 1 and August 16, 2013 for phase 2. Bids shall reflect all costs necessary to meet this schedule requirement.

BLUE EARTH AREA SCHOOL BOARD MINUTES

The regular meeting of the Board of Education of the Blue Earth Area, I.S.D #2860 was held on Monday February 13, 2012 in Frost, MN.

Present were School Board members: J. Haugh, T. Cahill, M. Eckhardt, D. Fellows, V. Hanson, F. Bly, and S. Becker.

Also attending were Supt. Brandsoy, Principals Grant, Eustice, & McGuire, members of the press, staff and public. Also in attendance was Butch Hanson, a consultant for the superintendent search.

The meeting was called to order at 6:30 p.m. by Chairperson Bly. The Pledge of Allegiance was recited.

On a Haugh/Hanson motion the board approved the agenda. Unanimous approval.

Public Input: None

On a Becker/Fellows motion, the board unanimously approved the minutes from the January meeting.

The board unanimously approved seven money transfers in the amount of $ 967,355.91. Fellows/ Hanson.

Chairman Bly would like to extend the thanks of the board to the Frost community club for providing refreshments during our meeting.

Superintendents Report:

The district acknowledges the week of Feb. 20th as School Board Recognition week.

BEA would like to acknowledge this years triple A award winners Marissia Hagedorn and Jake Wagner.

An update on the k-8 facility upgrade was given. A walk through will be held on March 8th and bids are due on March 20th.

Principal Reports:

Principal Grant reported that a no child left behind waiver has been granted to the state of Minnesota. Eustice reported that registration is underway for classes next year and that the math and science departments are applying for a grant through Monsanto.

Butch Hanson was present to give the board their packets for the superintendent search. Of the 25 applications received, 15 were experienced superintendents and 10 were emerging leaders.

On a Cahill/Eckhardt motion the board unanimously passed a resolution designating February as kindness month. In favor were: Bly, Becker, Hanson, Eckhardt, Fellows, Cahill, and Haugh.

On a Becker/Haugh motion the board unanimously approved policy 524 which related to internet acceptable use and safety policy.

On an Eckhardt/Hanson motion the board unanimously approved the non-certified seniority list.

On a Hanson/Cahill motion the board unanimously approved a contract with Travis Armstrong to be the robotics coach.

On an Eckhardt/Fellows motion the board approved the resignation of Kristin Thompson.

On a Haugh/Hanson motion the board unanimously approved a leave request for Carma Sunken.

On an Eckhardt/Haugh motion the board unanimously approved a lane change for Jayne Vogelsang from a BA15 to a BA30.

On a Cahill/Becker motion, the board was dismissed at 7:35pm

A special meeting of the Board of Education of the Blue Earth Area, I.S.D #2860 was held on Thursday February 23, 2012 at Hamilton Hall in Blue Earth, MN.

Present were School Board members: J. Haugh, T. Cahill, M. Eckhardt, F. Bly, D. Fellows, V. Hanson, and S. Becker. Also in attendance were Ed Waltman and Butch Hanson with the South Central Service Cooperative.

The meeting was called to order by Chairman Bly at 9:25pm.

The sole purpose of this meeting was to discuss the position of superintendent, which will be open on July 1st, as current Superintendent Dale Brandsoy will be retiring effective June 30th. The board has voted unanimously to offer the job to Evan Gough who is currently an assistant principal for the district of Red Wing. The district will now enter into negotiations with Mr. Gough. The board would like to thank the members of the community that took time to help us with the interview process. The amount of community and staff involvement in this process was much appreciated by the board. Also, we would like to thank our consultants Ed Waltman and Butch Hanson who coordinated this process through the South Central Services Cooperative. On a Becker/Cahill motion, the board was dismissed at 9:34pm

Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate, including the power to collect all assets, pay all legal debts, claims, taxes and expenses, to sell real and personal property, and do all necessary acts for the Estate.

Notice is also given that (subject to Minn. 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

ORDINANCE NO. 12-02

CITY OF BLUE EARTH

AN ORDINANCE TO AMEND CERTAIN SECTIONS

OF THE BLUE EARTH CITY CODE TO DELETE

UNUSED PROVISIONS AND CORRECT INCONSISTENT PROVISIONS

The City Council of the City of Blue Earth does ordain as follows:

SECTION I.

That Subsection 250.08 Joint Airport Zoning Board is hereby repealed, revoked, rescinded and deleted in its entirety.

SECTION II.

That Subsection 800.01, Subd. 3 Utility Coordination Committee, is hereby repealed, revoked, rescinded and deleted in its entirety.

SECTION III.

That Subsection 710.01, Subd. 1 is hereby amended to state the following:

Subd 1. Composition. A board of Public Works consisting of five (5) elected members serving terms of four (4) years shall exist in the City of Blue Earth in accordance with Chapter VII of the Charter for the City of Blue Earth.

SECTION IV.

This Ordinance shall not be effective until thirty (30) days after its passage and

publication.
