It is Ordered and Notice is given that on May 27, 2014, at 10:30 a.m., a hearing will be held in this Court at Blue Earth, Minnesota, for the formal probate of an instrument purporting to be the Will of the Decedent, dated June 24, 2009, (“Will”), and for the appointment of Alice Prestegard, whose address is St. Luke’s Lutheran Care Center, 1219 S. Ramsey, Blue Earth, MN 56013 as Personal Representative of the Estate of the Decedent in an Unsupervised administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and do all necessary acts for the Estate.

Notice is also given that (subject to Minn. Stat. 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

APRIL 1, 2014

1. All members were present. The pledge of allegiance was recited.

2. Approved synopsis and official proceedings of the March 18, 2014 regular meeting.

3. Approved agenda of April 1, 2014.

4. Approved increasing per diem for Veteran Services drivers to $120 per day effective April 1, 2014.

5. Hired Laura Weber as a STEP part-time employee.

6. Hired Eric Neubauer of Wells and Briar Bonin of Blue Earth as part-time Sheriff Deputies.

7. Hired Glenn Hassing of Blue Earth as full-time Building Maintenance Worker.

8. Accepted low bid for 635 tons of seal coat oil of $323,564.25 from H G Meges of Eau Claire WI. Two other bids were received: $325,818.50 from Flint Hills Resources LP of West Fargo ND and $370,782.85 from Jebro Incorporated of Sioux City IA.

9. Accepted contract with Erickson Engineering for engineering design services for Bridge 22519 on CSAH 4 at an estimated fee of $31,500.

10. Accepted low bid for CSAH 13 project of $2,217,100 from Ulland Brothers, Inc. of Albert Lea. One other bid of $2,998,690 was received from Southern MN Construction Co. Inc. of Mankato. 11. Approved Resolution 14-PZ04-13 for an advance from the 2015 State Aid Regular Construction Account of $1,128,423. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young voted yes.

12. Approved a municipal improvement policy that outlines the county’s share of municipal CSAH projects.

13. Approved requests from A. Huston to attend a 3-day Fraud Investigators spring conference in Walker and L. Frommie to attend a 1-day South Central Mn Emergency Preparedness conference in Mankato.

14. Accepted sole bid of $6,200 from G & S Drainage to clean up tax forfeited house on Parcel No. 26.200.0850. Commissioners Groskreutz and Warmka voted no.

15. Adopted Resolution 14-CB-14 authorizing issuance, awarding sale, prescribing the form and details and providing for the payment of $7,480,000 General Obligation Jail Refunding Bonds, Series 2014A. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young voted yes. Chuck Upcraft of The PFM Group attended.

16. Approved payment bills totaling $56,940.74.

Discussion was held concerning the following:

1. L. Warmka met regarding economic development business.

2. D. Hanson met regarding veteran services business.

3. D. Fellows met regarding central services business.

4. J. McDonald met regarding public works business.

Complete minutes are on file in the Central Services Office.

The meeting was recessed to 1:00 p.m. Drainage Authority meeting.

NOTICE OF HEARING

FOR CONDITIONAL USE

REQUEST

Notice is hereby given that the Faribault County Planning Commission will meet on Tuesday, May 13, 2014, at 7:00 PM in the Conference Room of the Faribault County Ag. Center, Inc. Blue Earth, MN.

The meeting agenda will include a Public Hearing on the application of More’s Ag Center for a Conditional Use Permit.

Applicant is requesting a Conditional Use Permit for up to three (3) 30,000 gallon LP?gas storage tanks in the A-2 General Agricultural District.

The site is located at the following described property: The Northwest Quarter (NW1/4) of the Northeast Quarter (NE1/4) of Section Fifteen (15) in Township One Hundred Two (102) North, Range Twenty-six (26) West, Emerald Township, Faribault County, Minnesota.

ORDINANCE NO. 14-03

CITY OF BLUE EARTH

AN ORDINANCE FOR THE CONVEYANCE OF REAL PROPERTY

OWNED BY THE CITY OF BLUE EARTH

The City Council of the City of Blue Earth do ordain as follows:

SECTION I

The City of Blue Earth owns certain property located in and adjacent to the City of Blue Earth legally described as follows:

Lots 1 and 2, Block 1 and Lots 1 and 2, Block 2, North Industrial Park Addition to the City of Blue Earth, Faribault County, Minnesota.

SECTION II

Nextera Properties, LLC is desirous of purchasing property in Section I above and the City of Blue Earth is desirous of selling such property for a sale price of $192,225.00.

SECTION III

Pursuant to the provisions of Chapter 12, Section 12.02 of the City Charter of the City of Blue Earth, the City of Blue Earth is hereby authorized to sell and the Mayor and City Administrator are hereby authorized to convey the property described in Section I of this ordinance to the purchaser upon payment of the purchase price.

SECTION IV

This Ordinance shall not be effective until thirty (30) days after its passage and publication.

Passed and adopted by the City Council of the City of Blue Earth on this 21st day of April, 2014.
