Delavan lawsuit settled

Owner of the Johnny M’s bar to get check for $109,000

Following a closed-session meeting of the Delavan City Council, it appears the legal dispute between the city and Johnny M’s Tavern has come to an end.

John Martin, the former owner of Johnny M’s Tavern, will receive a check for $109,000 per terms of the agreement reached between the two parties.

Of the $109,000 total, the city will pay $84,250 while the remaining $24,750 will be covered by the city’s insurance coverage through the League of Minnesota Cities.

“The agreement has been signed by both parties,” Delavan mayor Dan Haugh said. “The check has been written and delivered.”

Haugh noted the final step is for both sides to ask for the legal case to be dismissed by the District Court.

The legal case was brought by Martin who claimed former mayor Kevin Walker, along with council members Max Abdo, Christopher Kruse and Haugh, had wrongfully canceled Martin’s lease with the city for the use of the building which housed his bar. Martin also claimed his liquor license was wrongfully revoked.

The bar, now called BluBair, was recently reopened under new ownership.
