No bid will be accepted unless sealed and filed with the City Clerk and accompanied by a certified check or bidder’s bond payable to the City of Minnesota Lake for not less than five percent (5%) of the TOTAL BID PRICE, as a guarantee that the bidder will, within ten (10) days after notification of award of contract enter into an agreement with the City and furnish a performance bond and a payment bond for the full amount of the Contract as provided by law. If the low responsible bidder, upon the award of the Contract, shall fail to enter into the Contract, the amount of such certified check or bidder’s bond shall be forfeited to the City as liquidated damages.

Bid security of all bidders may be retained until the contract has been awarded and executed, but not longer than sixty (60) days from the date of opening bids.
