1. All commissioners were present. The pledge of allegiance was recited.

2. Approved synopsis and official proceedings of the June 3, 2008 regular meeting.

3. Approved agenda of June 17, 2008.

4. Approved request to issue change order from CAM, Inc. P.N. #05-1-295 resulting in a total cost deduction of $24,797.61 on the law enforcement center. Conferenced with Mike Kearns of CAM, Inc. by telephone.

5. Interim 4-H Program Coordinator Donna Leff introduced herself to the board.

6. Approved advertising a request for proposal for the operation of Faribault County Area Transit as presented with language clarified for a two year contract with an option of an additional year.

7. Approved a new cost schedule for guaranteed services effective July 1, 2008 as half of the actual cost of service.

8. Approved an SSTS loan of $7,653.12` to Lester and Mavis Egeness on Parcel No. 16.010.0300 in Rome Township.

9. Accepted quote for street signs from Earl F. Andersen, Inc. of Bloomington for $43,898.45. Other quotes received were $45,135.55 from Newman Signs of Jamestown ND and $61,742.74 from M-R Sign Co., Inc of Fergus Falls.

10. Approved amended Joint Powers agreement between the Minnesota Counties Computer Cooperative (MCCC) and Human Services of Faribault and Martin Counties.

11. Approved application for increase in 2008 taxes payable of $174 to Pamela J. Worden on Parcel No. 21-200-9111 in the city of Blue Earth and of $300 to Randal L. and Deann M. Phillips on Parcel No. 02-007-1300 in Blue Earth Township.

12. Approved request of K. Skaare to attend a two-day Sidwell legal description seminar in St. Peter.

13. B. Roverud discussed the Public Defender’s position that they will no longer be handling Children In Need of Protective Services (CHIPS) cases.

14. Assess liquidated damages of $17,250 to Gaub, Inc. for Huntley Contract B.

15. Approved payment of bills totaling $1,049,758.17.

Discussion was held concerning the following:

Area Transit

The Faribault County Board of Commissioners will accept sealed bids for the Operation of the Faribault County Area Transit by 9:00 a.m., July 30, 2008. Bids may be mailed or delivered to the Faribault County Auditor, 415 North Main, PO Box 130, Blue Earth, MN 56013. All bids shall be in a sealed envelope with the words “SEALED BID ENCLOSED” prominently displayed on the front of envelope. Faribault County reserves the right to reject any or all bids.

ORDINANCE NO. 08-06

CITY OF BLUE EARTH

AN ORDINANCE AMENDING

SUBSECTION 510.03

OF THE BLUE EARTH CITY

CODE CONCERNING

CONDITIONS FOR GRASS AND WEEDS FOUND

TO BE A PUBLIC NUISANCE AND ABATEMENT THEREOF

The City Council of the City of Blue Earth do ordain as follows:

The City Council hereby amends Subsection 510.03 to the City Code as follows:

SUBSECTION 510.03 – GRASS AND WEEDS

Subd. 2. Notice and Assessment. If such owner, occupant or agent fails to comply with said height limitation, notice of the violation shall be given to him or her from a City officer or employee. The notice shall state that the owner or occupant has three (3) days to abate the nuisance or the City will cut the grass or weeds at the expense of the owner. The notice shall also state that the owner has a right to appeal the order to abate the nuisance within three (3) days. If the nuisance has not been abated within three (3) days of such notice, and no appeal of the order has been made, the City shall cause such grass and weeds to be cut and the expense thereof shall be billed to the property owner due upon receipt of the bill. In the event of non-payment by the property owner, the amount due after September 1 of each year, plus interest, shall be certified by the Council to the County Auditor for collection as a special assessment against the affected property.

Subd 3. Appeal. Any person aggrieved by an order of a City officer or employee to cut grass and weeds on his or her property may appeal the order to the Council by filing a written request with the Clerk-Administrator within three (3) days of receiving notice of the Order. A hearing on the matter shall then be scheduled before the Council and the appellant shall be provided notice stating the time and place for the hearing.
