NOTICE TO FILE CLAIMS
By Order of the Court dated November 7, 2008, R. Lawrence Harris was appointed Master in the Court Supervised voluntary dissolution of the above named Corporations. Pursuant to the Court’s delegation of the authority, the Master entered a further order setting the following deadlines for the submission of claims of creditors of the above named Corporations and a procedure for the further adjudication of such claims, as follows:
1. Notice to Creditors and Claimants. This Notice is provided by the Corporations to each creditor of and claimant against the Corporations; and in conformance with Minn. Stat. § 302A.727, subdivisions 1 and 2. All claims are to be filed with the Blue Earth County Court Administrator and Master, under oath, by no later than March 23, 2009 in the form of a Proof of Claim, and that any claims not filed in such manner by such date shall be barred except as otherwise provided for by law.
2. Review and Consideration of Claims by Master. The Master shall review and consider each duly submitted claim, and shall, within 30 days of receipt thereof, either accept or reject the claim by giving written notice to the person submitting it. The notice rejecting any claim shall include notification of the process which the creditor or claimant shall follow for the submission of additional evidence and legal argument, and to request an evidentiary hearing.
3. Rejected Claims. Any creditor or claimant whose claim is rejected by the Master pursuant to Paragraph 2 shall be entitled to submit any additional evidence and legal argument in support of the claim to the Master, and to request that the claim be considered at an evidentiary hearing to be conducted before the Master. The Master shall duly schedule a requested hearing and provide notice to the creditor/claimant of the date, time, and place of such.
4. Recommendations by Master and Final Disposition by Court. Upon conclusion of the procedures set forth above, the Master shall file with the Court a report setting forth the Master’s recommendations with respect to the resolution of all claims duly filed and submitted to the Master. The Master shall serve a copy of the report upon all parties and upon all other creditors and claimants who have duly filed a claim. The Court shall act upon the Master’s recommendations and determine the final disposition of all such claims as provided for by Minn. R. Civ. P. 53.07.
5. Required Statements.
A. The above Corporations are in the process of dissolving.
B. The above Corporations have filed with the Secretary of State their respective Notices of Intent to Dissolve.

1. Commissioners Erichsrud, Groskreutz, Loveall, Steier, and Warmka were present. The pledge of allegiance was recited.
2. Approved synopsis and official proceedings of the December 2, 2008 regular meeting and the December 4, 2008 truth in taxation hearing.
3. Approved agenda of December 16, 2008.
4. Recognition was given to the following employees for length of service: Mark Walton of Public Works for 30 years of service; Elizabeth Boettcher of the Auditors office, Bryan Schultz of Veteran Services, and Brenda Ripley of Central Services for 25 years of service; Sheryl Asmus of the Recorder’s office, Chris Anderson, Geary Wells, and Joe Anderson of the Sheriff’s office for 20 years of service; and Dave Hanson of Public Works, Donna Steele of the Extension office, and Mike Jacobson of Building and Grounds for 15 years of service.
5. Approved that effective December 16, 2008 any new hire for the full time positions of Dispatcher or Dispatch/Jailer will be determined as follows: the position will be defined as Dispatcher if 80% of time worked is dispatching and will be covered under the coordinated PERA (public employees retirement association) or the position will be defined as Dispatch/Jailer if 80% of time worked is in the jail and will be covered under the correctional PERA. Dispatch/Jailer position will be cross trained in both dispatching and jailing areas. Any internal transfer of an employee into the dispatcher position will automatically be enrolled in the coordinated PERA.
6. Approved the following SSTS loans: $14,424.57 to Mark Mensing for Parcel No. 07.015.0200 in Elmore Township and $6,800 to Mike Gjere on Parcel No. 02.028.0701 in Blue Earth Township.
7. Approved hiring a Technical Administrator I in the Auditor/Treasurer office.
8. Approved Resolution 08-CB-30 setting the 2009 county commissioner salary at $17,755.66, per diems at $80 per day, and mileage reimbursement as set by the Internal Revenue Service. Commissioners Groskreutz, Loveall, Steier, and Warmka voted yes. Commissioner Erichsrud voted no.
9. Approved Resolution 08-CB-31 authorizing payment of bills before the end of the current year on December 29, 2008. Commissioners Erichsrud, Groskreutz, Loveall, Steier, and Warmka voted yes.
10. Approved Resolution 08-CB-32 authorizing the auditor to advance ditch funds from the General Revenue Fund on December 31, 2008. Commissioners Erichsrud, Groskreutz, Loveall, Steier, and Warmka voted yes.
