NOTICE OF HEARING ON PROPOSED ASSESSMENT

Winnebago, Minnesota

TO WHOM IT MAY CONCERN:

Notice is hereby given that the council will meet at 7:00 p.m. on November 10, 2009 at Winnebago City Hall to consider, and possibly adopt, the proposed assessment for the improvement of Sixth Street Southwest between First Avenue Southwest and Third Avenue Southwest. Adoption by the council of the proposed assessment may occur at the hearing.

Such assessment is proposed to be payable in equal annual installments extending over a period of 15 years, the first of the installments to be payable on or before the first Monday in January 2010, and will bear interest at the rate of 6.15 percent per annum from the date of the adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2025. To each subsequent installment when due shall be added interest for one year on all unpaid installments.

You may at any time prior to certification of the assessment to the county auditor, pay the entire assessment on such property, with interest accrued to the date of payment, to the City Clerk of Winnebago. No interest shall be charged if the entire assessment is paid within 30 days from the adoption of this assessment. You may at any time thereafter, pay to the City Clerk of Winnebago the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is 6.15 percent per year. The right to partially prepay the assessment is available.

The proposed assessment roll is on file for public inspection at the City Clerk’s office. The total amount of the proposed assessment is $ 49,466.98. Written or oral objections will be considered at the meeting. No appeal to district court may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable.

If an assessment is contested or there is an adjourned hearing, the following procedure will be followed:

1. The city will present its case by first calling witnesses who may testify by narrative or by examination, and by the introduction of exhibits. After each witness has testified, the contesting party will be allowed to ask questions. This procedure will be repeated with each witness until neither side has further questions.

2. After the city has presented all its evidence, the objector may call witnesses or present such testimony as the objector desires. The same procedure for questioning the city’s witnesses will be followed with the objector’s witnesses.

3. The objector may be represented by counsel.

4. Minnesota rules of evidence will not be strictly applied; however, they may be considered and argued to the council as the weight of items of evidence or testimony presented to the council.

5. The entire proceedings will be tape-recorded.

6. At the close of the presentation of evidence, the objector may make a final presentation to the council based on the evidence and the law. No new evidence may be presented at this point.

7. The council may adopt the proposed assessment at the hearing.

An owner may appeal the assessment to district court pursuant to Minn. Stat. 429.081 by serving notice of the appeal upon the mayor or clerk of the city within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the mayor or clerk.

AN ORDINANCE TO AMEND SUBSECTION 240.06 OF THE ELMORE CITY CODE CONCERNING ABATEMENT OF NUISANCE GRASS AND WEEDS MAINTAINED WITHIN CITY LIMITS

The City Council of the City of Elmore do ordain as follows:

SECTION I

That Subsection 240.06 of the Elmore City Code is amended to read as follows:

240.06 When City to Perform the Duties Necessary to Accomplish the Purpose of this Code Section. If the provisions of the foregoing subsections are not complied with, the City shall send notice to the owner or lessee or occupant or any person having control of any lot or parcel of land via first class mail, postage prepaid, to comply with the provisions of this Section. If the person to whom such notice has been sent fails, neglects, or refuses to perform the duties necessary to comply with the provisions of such notice within three (3) days after the mailing of such notice, the City shall cause such duties to be performed and the actual cost, plus fifteen percent (15%) for inspection and other costs in connection therewith, shall be certified by the City Clerk to the owner of record of such lot or parcel. If payment for performance of the duties are not received by the City Clerk within thirty (30) days of such certification, such charges shall become a lien upon the affected property and shall be added to and become part of, the taxes next assessed upon such lot or parcel of land and shall be collected in the manner of the other taxes and assessments.

SECTION II

This ordinance shall not be effective until 30 days after its passage and publication.

AN ORDINANCE TO AMEND SUBSECTION 530.09 OF THE ELMORE CITY CODE

The City Council of the City of Elmore do ordain as follows:

SECTION I

That Subsection 530.09, Subd. 1 is hereby amended to read as follows:

Subd. 1. Adult Uses shall be permitted in areas zoned as defined in Chapter 10 of the Elmore City Code, provided the following requirements are met:

A. No adult uses shall be located within eight hundred (800) feet of:

1. Any area zoned Residential, Commercial or Agricultural.

2. Any school, as defined in Minnesota Statues 120.101.

3. Any church or church related organization.

4. Any licensed daycare facility, or any residential/nonresidential program, as defined in Minnesota Statutes 245A.02.

5. Any hotel or motel.

6. Any public park.

7. Hospitals/Clinics.

8. Any youth establishment.

9. Any nursing home.

10. Any establishment holding a valid liquor license issued by the City.

B. Adult uses shall not be established or maintained as a permitted, conditional or accessory use in any area other than those described in paragraph A above.

SECTION II

This Ordinance shall not be effective until seven (7) days after its passage and publication.

AN ORDINANCE TO REPEAL THE ORDINANCE ENACTING A MORATORIUM ON

DEVELOPMENT OF ADULT USE BUSINESS

ESTABLISHMENTS WITHIN THE CITY

The City Council of the City of Elmore do ordain as follows:

SECTION I

That the Ordinance enacting a moratorium on development of adult use business establishments within the City is hereby repealed in its entirety.

SECTION II

This Ordinance shall not be effective until seven (7) days after its passage and publication.
