72.00 REPEAL.

Chapter 71. Traffic Regulations, Chapter 76. Traffic Schedules, and the previous Chapter 72. Parking Regulations are hereby repealed upon enactment of this new Chapter 72. Parking Regulations.

72.01 DEFINITIONS.

For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

MOTOR VEHICLE. All vehicles propelled by any other than muscular power.

OPERATOR. Every person driving or operating a motor vehicle upon the streets in the city.

OWNER. Any person, firm, association or corporation owning or renting a motor vehicle or having the exclusive use thereof under a lease or otherwise for a period greater than 30 days.

72.02 TRAFFIC CODE

EXCEPTIONS. Any and all city owner vehicles or equipment. All emergency service vehicles. Service or delivery vehicles are allowed on all streets for the sole purpose of services or deliveries.

GENERAL RULE. The city council shall retain the power to administer temporary parking privileges or revoke any parking privileges, or erect signs limiting parking in any area by recommendation of the police department.

72.03 PARKING RESTRICTIONS.

(A) All vehicles on streets in the city and not in motion shall be parked on the right hand side of the street in such manor as not to obstruct public travel, with the following exceptions:

(1) Every motor vehicle stopped or parked upon a two-way roadway, including T.H. 169 where there is any adjacent curb shall be so stopped or parked with the right-hand wheels of the vehicle parallel with and within 12 inches of the right-hand curb.

(2) On all those portions of the streets that intersect main street, all vehicles must park at an angle of 45 degrees from the curb where such angle parking is designated by curb lines or street markings. No vehicle shall be parked on or straddling any such markings.

(3) There shall be no parking of any motor vehicle on any street or alley from 12 a.m. to 6 a.m. local time, except parking from 12 a.m. to 6 a.m. local time will be permitted April 15 until November 15 of each year. Parking in city lots is permitted, however, vehicles are required to be moved to facilitate snow removal.

(4) There shall be no parking of any motor vehicle at any time on city sidewalks or in a manner blocking a public or private driveway, or in the city park or within the street right-of-way.

(5) There shall be no parking of any motor vehicle on the public alley of the city, except for the purpose of loading and unloading provided parking shall be made with the least inconvenience to the passing traffic in said alley.

(6) No trucks loaded with ensilage of any kind shall park on the streets or alleys in the city.

(7) It shall be the duty of the city police to cause any such motor vehicle which is in violation of this section to be ticketed and/or removed by a privately operated towing service and said vehicle shall not be released until fees for towing and storage are paid in full; these fees to be in addition to any fine for the violation of the regulations as herein after stated.

72.04 RESIDENTIAL STREETS.

(A) No motor vehicles exceeding 5 ton per axle are allowed on any residential street.

(B) No motor vehicles larger than a 1 ton pickup are allowed on any residential street.

(C) No semi truck-trailers are allowed on any residential streets.

72.05 TRUCK ROUTES

(A) Map. The city truck route map and all notations, references and data shown thereon are adopted and made part of this chapter and will be on permanent file for public inspection in city hall. It shall be the responsibility of the city to maintain the map, and amendments thereto shall be recorded thereon within 30 days after official publication of amendments.

(B) Signs. The city shall erect appropriate signs on streets designated City Truck Route.

(C) Restrictions.

(1) All designated truck routes inside city limits have a 10 ton per axle limit.

(2) No trucks may block any alley or driveway.

(3) No truck parking within 75 feet of any intersection.

(4) No truck parking on any designated street for more than 12 consecutive hours in any 24 hour period.

(5) Refrigerated units running on a trailer are prohibited within 150 feet of a residence.

(6) No truck engine shall be left running for more than 1 hour.

(7) City Council has the right to revoke any individual parking privileges within city limits upon request of the city police department.

This ordinance shall become effective upon its passage and publication according to the law. Passed by the City Council this 10th day of November, 2009.

Peterson whose address is: 43676 130th Street, Blue Earth, MN 56013, as personal representative of the Estate of the Decedent in an Unsupervised administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the personal representative will be appointed with full power to administer the Estate, including the power to collect all assets, pay all legal debts, claims, taxes and expenses, to sell real and personal property, and do all necessary acts for the Estate.

Notice is also given that (subject to Minn. 524.3-801) all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

HEARING ON THE ISSUANCE OF REVENUE BONDS

BY THE CITY OF

BLUE EARTH, MINNESOTA

NOTICE IS HEREBY GIVEN that a public hearing shall be conducted by the City Council of the City of Blue Earth, Minnesota (the “City”), relating to the issuance of up to approximately $1,500,000 of revenue bonds or other obligations there under to finance improvements to the nursing home (the “Project”) located at 1219 South Ramsey Street in the City that is owned and operated by St. Luke’s Lutheran Care Center, Inc. (the “Corporation”). The public hearing will be held at the Blue Earth City Hall on Monday, January 4, 2010, at 5:05 o’clock P.M. At said time and place the City Council of the City shall give all parties who appear an opportunity to express their view with respect to the Project and the proposed issuance of bonds.

The bonds shall be limited obligations of the City and the bonds and interest thereon shall be payable solely from the revenues pledged to the payment thereof. No owner of any such bonds shall ever have the right to compel the taxing power of the City to pay the bonds or the interest thereon, nor to enforce payment against any property of the City except the Project.

A draft copy of the proposed Application to the Minnesota Department of Employment and Economic Development, together with all attachments and exhibits will be available for public inspection following publication of this notice, at the offices of the City, Monday to Friday, except legal holidays, from 8:00 o’clock A.M. to 4:30 o’clock P.M., to and including the date of the hearing
