It is Ordered and Notice is given that on July 17, 2012, at 10:30 a.m., a hearing will be held in this Court at Blue Earth, Minnesota, for the formal probate of an instrument purporting to be the Will of the Decedent, dated March 5, 2007, and for the appointment of Joyce M. Larson, whose address is 59665 35th St., Kiester, MN 56051 as Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration.
Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.
Notice is also given that (subject to Minn. 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.
A charitable beneficiary may request notice of the probate proceedings be given to the Attorney General pursuant to Minn. Stat. 501B.41, subd. 5.

ORDINANCE NO. 12-05
CITY OF BLUE EARTH
AN ORDINANCE TO AMEND CERTAIN PROVISIONS OF THE BLUE EARTH CITY
ZONING CODE PERTAINING TO GARAGES
The City Council of the City of Blue Earth does ordain as follows:
SECTION I.
Subsection 1000.06, Subd. 33. Garage Private is hereby amended and revised to state as follows:
Subd. 33. Garage Private. The phrase Garage Private means (1) an accessory building or portion of the principal building upon any lot where the primary building is a private dwelling which is intended for and used to store private passenger vehicles of the family or families resident upon the premises or (2) a private storage building built as the primary structure upon a single lot or part of a lot adjacent to and abutting a lot owned by the same person(s) that has built upon it a private dwelling. The adjacent and abutting lot shall border the primary dwelling lot for at least 50 feet.
SECTION II.
Subsection 1010.10. Garage Setback Permits is hereby repealed, removed and deleted in its entirety.
SECTION III.
That Paragraph 1150.02, Subd.1, subpart B requiring a certified survey for a simple lot split be amended to state the following:
B. A certified survey at the discretion of the zoning administrator if any portion of the proposed lot to be split or the adjacent lots are described by metes and bounds descriptions.
SECTION IV.
This Ordinance shall not be effective until thirty (30) days after its passage and publication.

3. Presented an award to Veteran Services Officer David Hanson from the Veteran Justice Advocate Program for going above and beyond the call in helping a fellow veteran and their family.
4. Approved a $16,606.80 SSTS loan to Christopher and Robyn Mathews on Parcel No. 02.014.0500 in Blue Earth Township.
5. Approved Resolution 12-PZ04-21 granting a conditional use permit to Doug and Christie Wetzel for a feedlot in Walnut Lake Township. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young voted yes.
6. Set public hearing for the adult use ordinance for June 25, 2012 at 7:00 p.m.
7. Approved advertising for bids to be taken on CSAH 2 bridge until June 28, 2012 at 11:00 p.m.
8. Accepted $100 donation from the American Legion Post 454 of Kiester for the Faribault County Fair.
9. Approved Resolution 12-CB-22 for a five year Joint Powers Agreement with the counties of Blue Earth, Brown, Faribault, Le Sueur, Martin, Nicollet, Sibley, Waseca, and Watonwan for South Central Workforce Council. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young voted yes.
10. Approved proposing to Faribault-Martin County Human Service a 5% rental rate increase.
11. Granted the request for subordination agreements on Small Cities Development Program loans dated July 8, 2010 to Mary Bryson of Walters MN.
12. Young motion to close the session to discuss the appointment of a county assessor died for lack of a second.
13. Tabled appointment of Lynn Krachmer as County Assessor to the June 19, 2012 board meeting. Commissioners Groskreutz and Roper voted no.
14. Approved requests of S. Cory to a one-day preparing for the MN Residential Form Report and Property Case Study Exam Workshop; K. Boettcher and A. Porter to attend a five-day Pressure Point Control Tactics Train the Trainer class in Jackson County; D. Killion to attend a one-day Drugs That Impair Driving & Occupant Protection Usage & Enforcement class in Winnebago; D. Killion to attend a one-day Emergency Vehicle Operator Course & Pursuit Driving in Blue Earth; D. Killion to attend a two-day Standardized Field Sobriety Testing in Winnebago; and J. McDonald to attend a three-day Minnesota County Engineer summer conference in Alexandria.
15. Approved payment bills totaling $189,385.62.
