AN ORDINANCE VACATING A PORTION OF A
PUBLIC ALLEY
LOCATED IN BLOCK 86 OF THE ORIGINAL PLAT FOR
THE CITY OF BLUE EARTH
The City Council of the City of Blue Earth do ordain as follows:
Section I
That all that part of the alley running east to west in Block 86 of the Original Plat to the City of Blue Earth between Lots 3, 4, and 5 on the north and Lots 6, 7, and 8 on the South in said Block 86 be vacated subject to an easement described in Section III.
Section II
That all that part of the South one-half of the alley running east to west in Block 86 of the Original Plat of the City of Blue Earth lying adjacent to the North line of Lot Nine (9) located in said Block 86 be vacated subject to an easement described in Section III.
Section III
The City of Blue Earth reserves a commercial easement in gross to maintain, construct, reconstruct, replace, remove, extend and improve utilities in such vacated street.
Section IV
This Ordinance is adopted pursuant to Section 12.04 of the Charter of the City of Blue Earth and all notices and hearings have been conducted in a manner provided by law.
Section V
This ordinance shall be in full force and effect from and after its passage and publication.

NOTICE OF HEARING
on Assessments for
Improvement of Tenth Street from Moore to Ramsey, Eleventh Street from

Seventh Street to
Fourteenth Street.
Notice is hereby given that the council will meet at 5:05 p.m. on September 17, 2012 at City Hall to consider, and possibly adopt, the proposed assessment for the Tenth Street from Moore to Ramsey Street, Eleventh Street from Galbraith Street to Ramsey and Galbraith Street from Seventh Street to Fourteenth Street Improvements. Adoption by the council of the proposed assessment may occur at the hearing. The proposed roll is on file with the City Clerk and open to public inspection.
The area proposed to be assessed Tenth Street from Moore Street to Ramsey Street, Eleventh Street from Galbraith Street to Ramsey Street and Galbraith Street from Seventh Street to Fourteenth Street Improvements by sanitary sewer, storm sewer, water main, street construction, and sidewalk and boulevard improvements, and this report was received by the council on .
The total amount to be assessed for the improvements is $792,096.02 and is payable in annual installments over a period of 15 years. Written or oral objections will be considered at the hearing.
An owner of property to be assessed may appeal the assessment to the district court of Faribault County pursuant to Minnesota Statutes, Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or Clerk.
No appeal may be taken as to the amount of any assessment adopted by the City Council unless a written objection, signed by the affected property owner is filed with the Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. All objections to the assessments not received at the assessment hearing in the manner prescribed by Minnesota Statutes, Section 429.061 are waived, unless the failure to object at the assessment hearing is due to a reasonable cause.
Under the provisions of Minnesota Statutes, Section 435.193 to 435.195, the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make payments.

NOTICE OF APPLICATION FOR LIVESTOCK
FEEDLOT PERMIT
Notice is hereby given per Minnesota Statutes, Chapter 116, that Arnold and Marcia Swanson has made application to the Minnesota Pollution Control Agency or the County of Faribault for a permit to construct or expand a feedlot with a capacity of 500 animal units or more.
The proposed feedlot will be located in the SW1/4 of the SW1/4 of Section 25, Pilot Grove Township (T. 101N, R. 28 W.), Faribault County, Minnesota, The existing facility consists of 25 Beef Cow/Calf pair (30 animal units) housed in a partial confinement barn. The proposed new facility will consist of 2,400 swine between 55 and 300 pounds (960 animal units) housed in a 102 foot by 192 foot total confinement barn with 8 foot deep poured reinforced concrete pit for manure storage. The total animal unit capacity will be 990 animal units.
This publication shall constitute as notice to each resident and each owner of real property within 5,000 feet of the perimeter of the proposed feedlot as required by Minnesota State Law.
A public meeting will be held on September 18, 2012, at 9:45 am at the Faribault County Board of Commissioner’s meeting at the Faribault County Courthouse for citizen input in regard to the feedlot being permitted.
