NOTICE OF HEARING

TO ALL PERSONS INTERESTED IN COUNTY DITCH NO. 7, COUNTY DITCH NO. 20, AND COUNTY DITCH NO. 87 IN FARIBAULT COUNTY:

YOU AND EACH OF YOU WILL PLEASE TAKE NOTICE that the State of Minnesota, by Charles A. Zelle, its Commissioner of Transportation, has filed a Petition with the Auditor of Faribault County, pursuant to Minnesota Stat. 161.28, praying that he be allowed to make minor alterations in County Ditch No. 7, County Ditch No. 20, and County Ditch No. 87. That attached to said Petition now on file is a plan of the minor alterations petitioned for. That the portions of said County Ditch No. 7, County Ditch No. 20, and County Ditch No. 87 which are proposed to be altered are shown by maps and plans attached to said Petition.

That said Petition alleges that it is advantageous and desirable in the construction and maintenance of Trunk Highway No. 109 that said minor alterations be made, and that said minor alterations petitioned for will not affect the functioning nor impair the efficiency of said County Ditch No. 7, County Ditch No. 20, or County Ditch No. 87.

1. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young were present. Also present were Auditor/Treasurer/Coordinator J. Thompson, Attorney T. Timmerman, and Soil and Water/Planning and Zoning Program Administrator M. Stindtman.

2. Waived the reading of the resolution.

3. Added the condition that a flagman be present when trucks are hauling.

4. Approved Resolution 13-PZ08-21 granting a conditional use permit to John Arends / Ulland Brothers Inc. for the disposal of excess soils in Blue Earth City Township. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young voted yes.

JULY 23, 2013

1. All members were present. The pledge of allegiance was recited.

2. Approved synopsis and official proceedings of July 2, 2013.

3. Approved agenda of July 23, 2013.

4. Rejected sole bid received from Icon Constructors, LLC of $590,871.30 for the replacement of Bridge 89204 and re-bid in 2014 as recommended by the Minnesota Department of Natural Resources who is funding the replacement.

5. Approved an agreement with the Iowa Department of Transportation to use County Road 2 from Highway 169 west to the Martin County line as a detour during road construction of Highway 169 south of Elmore in 2014 and directed the chair to sign the agreement.

6. Accepted quote for deicing salt of $64.67 per ton from North American Salt Inc. of Overland Park, KS. Other quotes received were from Morton International Inc of Chicago IL for $65.79, Central Salt of Elgin IL for $66.66, Independent Salt Company for $71.75, and Mills & Miller, Inc. of Brandon SD for $73.00.

7. Accepted quote for traffic marking paint from AAA Striping of St. Michael MN for $79,626. One other bid was received from Traffic Marking Service of Maple Lake MN for $80,438.

8. Approved Resolution 13-RB08-22 for the implementation of wheelage tax. Commissioners Roper, Warmka, and Young voted yes. Commissioners Groskreutz and Loveall voted no.

9. Approved request of L. Eastman to attend a 3-day Mn CVSO conference in St. Cloud; D. Fellows to attend a 1-day Human Resources training in Sioux Falls, SD plus mileage for out of state travel and a two-day Human Resources training in St Cloud.

10. Approved an SSTS severance agreement with Ag Star Financial Services on Parcel No. 06.014.0200.

11. Approved payment bills totaling $224,695.91.

Discussion was held concerning the following:

1. M. Stindtman met regarding soil and water business.

2. Faribault, Martin and Jackson County Problem Solving Court Coordinator Miranda Rose met to update the board.

3. J. McDonald met regarding public works business.

4. Gene Stallkamp thanked the County Board and staff for holding their meeting at the Faribault County Fair.
