CITY OF BLUE EARTH

AN ORDINANCE FOR THE CONVEYANCE OF

REAL PROPERTY

OWNED BY THE

CITY OF BLUE EARTH

The City Council of the City of Blue Earth do ordain as follows:

SECTION I

The City of Blue Earth owns certain property located in the City of Blue Earth legally described as follows:

A tract commencing at a point in the North line of the Southwest Quarter of Section Eight (8) in Township One Hundred Two (102) North of Range Twenty-seven (27) West of the Fifth Principal Meridian in the County of Faribault, State of Minnesota, 1451.5 feet West of the Northeast corner thereof, thence Southwesterly at an angle of 77 degrees 40 minutes left with the said North line 500.7 feet to the point of beginning, thence continuing Southwesterly along said last course 115 feet, thence Easterly 273.1 feet to a point in the west right of way line of Trunk Highway #169, 677.4 feet South of the North line of said Southwest Quarter as measured along said right of way line; thence Northerly along said right of way line 117 feet, thence westerly 276.5 feet to point of beginning.

subject to any and all easements of record.

City of Blue Earth hereby further reserves a permanent utility easement 10.00 feet in width over, under and across a strip of land in the Southwest Quarter of Section 8, Township 102 North, Range 27 West, in the City of Blue Earth, Faribault County, Minnesota lying 5.00 feet (measured at right angles) on both sides of the following described Lines A and B. All easement sidelines shall be shortened or extended to terminate on the North, East and South sides of the tract described above herein deeded to the City of Blue Earth on May 26, 2011 and recorded and described in the Office of the County Recorder as document number 355158.

Line A:

Commencing at the Center of said Section 8; thence South 88 degrees 56 minutes 56 seconds West, (assumed bearing) along the north line of the Southwest Quarter of said Section 8, a distance of 1449.02 feet; thence South 11 degrees 23 minutes 11 seconds West, a distance of 501.02 feet to the northwest corner of a tract of land deeded to James A. Meyer and recorded and described in the Office of the County Recorder in Book 135 Deeds, Page 215; thence South 79 degrees 13 minutes 01 seconds East, along the north line of said Meyer tract, a distance of 39.89 feet to the point of beginning of Line A; thence South 32 degrees 53 minutes 02 seconds East, a distance of 20.59 feet; thence South 79 degrees 10 minutes 59 seconds East, a distance of 165.56 feet; thence South 37 degrees 20 minutes 36 seconds East, a distance of 59.39 feet to a point designated as “Point A” thence South 13 degrees 27 minutes 15 seconds West, a distance of 62.6 feet, more or less, to the south line of said Meyer tract and said Line A there terminating.

Line B:

Beginning at the above described “Point A”; thence North 78 degrees 23 minutes 59 seconds East, a distance of 12.3 feet, more or less, to the west right-of-way line of C.S.A.H. No. 6 (Main Street)(formerly Minnesota U.S. Highway No. 169) and said Line B there terminating.

SECTION II

Scott A. Lyon and Kathryn A. Lyon are desirous of purchasing property in Section I above and the City of Blue Earth is desirous of selling such property for a sale price of $1.00 and other valuable consideration.

SECTION III

Pursuant to the provisions of Chapter 12, Section 12.02 of the City Charter of the City of Blue Earth, the City of Blue Earth is hereby authorized to sell and the Mayor and Vice Mayor are hereby authorized to convey the property described in Section I of this ordinance to the purchaser upon payment of the purchase price.

SECTION IV

This Ordinance shall not be effective until thirty (30) days after its passage and publication.

Passed and adopted by the City Council of the City of Blue Earth on this 15th day of September, 2014.
