CITY OF BLUE EARTH

AN ORDINANCE TO CONVEY A TRACT OF REAL

PROPERTY OWNED BY THE CITY OF BLUE EARTH FROM THE ECONOMIC

DEVELOPMENT AUTHORITY TO BLUE EARTH LIGHT AND WATER DEPARTMENT

The City Council of the City of Blue Earth do ordain as follows:

SECTION I

The City of Blue Earth and the Economic Development Authority of the City of Blue Earth own certain property located in the City of Blue Earth legally described as follows:

A tract of land in OUTLOT A, BLUE EARTH SHOPPING CENTER ADDITION, in the City of Blue Earth, according to the plat thereof on file and of record in the office of the County Recorder, Faribault County, Minnesota, described as follows:

The Blue Earth Light and Water Department is desirous of purchasing the real property described in Section I above and the City of Blue Earth and the Economic Development Authority of the City of Blue Earth are desirous of selling said real property for a sale price of $200,000.00 payable to the Economic Development Authority of the City of Blue Earth via $100,000.00 cash and a pledge of $100,000.00 to said Economic Development Authority to be paid upon the construction of the first residential home being built upon a proposed residential development located on real property adjacent to said real property described in Section I above.

SECTION III

The City of Blue Earth further agrees that the real property described in Section I above shall remain zoned as an Agricultural Zone regardless of the classification of the real property adjacent to said real property.

SECTION IV

Pursuant to the provisions of Chapter 12, Section 12.02 of the City Charter of the City of Blue Earth, the City of Blue Earth is hereby authorized to sell and the Economic Development Authority of the City of Blue Earth is authorized to sell the real property described in Section I above and the Mayor and City Administrator and the President and Vice President of the Economic Development Authority are authorized to convey said real property to the purchaser upon payment of the purchase price.

SECTION V

This Ordinance shall not be effective until thirty (30) days after its passage and publication.

NOTICE TO CREDITORS

It is Ordered and Notice is given that on November 25, 2014, at 10:30 a.m., a hearing will be held in this Court at 415 N. Main St., Blue Earth, Minnesota, for the formal probate of an instrument purporting to be the Will of the Decedent dated, December 20, 1971, (“Will”), and for the appointment of Richard Mueller, whose address is 602 8th St. SW, Wells, MN 56097 as Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.

Notice is also given that (subject to Minn. 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.
