NOTICE OF HEARING ON 2016 STREET

IMPROVEMENTS

TO WHOM IT MAY CONCERN: Notice is hereby given that the City Council of Blue Earth will meet in the Public Safety Center meeting room at 120 S. Walnut Street at 5:05 p.m. on November 16, 2015, to consider the making of Improvement Main Street (C.S.A.H 6) an improvement on Main Street from Seventh Street north to Fifth Street and Sixth Street from Main Street to Nicollet Street pursuant to Minn. Stat. 429.011 to 429.111. The area proposed to be assessed for such improvement is all abutting and benefitted properties by the improvement. The estimated cost of the Main Street improvement is $1,611,095.00 and $486,160.00 for Sixth Street Improvement. A reasonable estimate of the impact of the assessment will be available at the hearing. Such persons as desire to be heard with reference to the proposed improvement will be heard at this meeting.

BLUE EARTH AREA SCHOOL BOARD PROCEEDINGS

October 19, 2015

The regular meeting of the Board of Education of the Blue Earth Area, I.S.D. #2860 was held on Monday October 19th, in Blue Earth, MN.

Present were School Board members: F. Bly, D. Fellows, S. Ripley, M. Maher, S. Hauskins, A. Patten and J. Haugh. Also Attending were Supt. Gough, principals, members of the press, staff and public.

The meeting was called to order at 6:30 p.m. by Chairperson Bly. The Pledge of Allegiance was recited.

Public Input: None

On a Haugh/Maher motion the board approved the agenda.

The board unanimously approved the minutes from the September meeting. Patten/ Hauskins motion.

Six money transfers in the amount of $1,153,994.44 were unanimously approved. Fellows/Ripley motion.

Action Items:

On a Haugh/Ripley motion the Board approved a change to the 2015-2016 school calendar making Feb. 12th a vacation day for staff and moving the teacher work day to June 8th.

A resolution for financial support of student activity fees was approved on a Maher/Hauskins motion. Voting in favor were Haugh, Maher, Fellows, Bly, Ripley, Patten and Hauskins.

On a Maher/Patten motion the Master Agreement with Certified Staff was unanimously approved.

The Board approved the updated elementary reading curriculum purchase on a Haugh/ Ripley motion.

The “Assurance of Compliance” for 2015-2016 was approved on a Patten/Maher motion.

The following hires were approved on a Hauskins/Patten motion.

On a Fellows/Haugh motion the following resignations were approved.

Marian Arndt – Computer Operator

Susan Salisbury – Cook’s Helper

The following leave of absence was approved on a Fellows/Haugh motion.

The following contract was approved on a Ripley/ Maher motion.

Lisa Kittleson – 1.0 FTE Kindergarten Teacher

On a Patten/Haugh motion the Board unanimously approved the Bullying Prevention Proclamation.

On a Maher/Patten motion the meeting was adjourned at 7:30 pm.

Approved minutes of October 6, 2015 regular meeting.

Approved agenda of October 20, 2015.

Released Parcel No. 22.010.1020 from the 2007 Small Cities Development Program Housing Repayment Agreements as recorded on Document 345673 in the amount of $15,088.00 and Document 345680 in the amount of $4,600 contingent upon completion of sale of property and payment of delinquent property taxes.

Approved 2015 Federal Boating Safety Supplemental Equipment Grant (CFDA 97.012) from the Minnesota Department of Natural Resources in the amount of $1,000.

Approved an Off Highway/All Terrain Vehicle grant of $9,822 for 2016 and 2017.

Approved quote received from Lake Mills Water Sports for a 2015 Sportsman 570 SP EPS ATV for $4,809.96. One other quote was received from Northstar Powersports and Marine of Albert Lea for $4,900.00.

Directed planning and zoning committee to draft a Renewable Energy Ordinance that includes solar energy.

Approved Resolution 15-CB-43 for a three year agreement with the University of Minnesota for providing Extension programs locally and employing Extension staff. Commissioners Groskreutz, Loveall, Roper, Warmka, and Young voted yes.

Closed meeting regarding negotiations of a settlement in tax court litigation.

Approved following financial institutions as depositories of funds for Faribault County for a one-year period: First Bank of Blue Earth, Wells Fargo Bank, First Financial Bank of Winnebago, Peoples State Bank of Wells, and State Bank of Easton.

Approved bid from Beemer Companies of Fairmont of $175,560.00 for the improvement to County Ditch No. 62. Other bids received were from Ground Works Backhoe Service, LLC for $194,224.50, Brunz Construction Company Inc. for $206,850.00, MPI Farms/Caesar Larson for $212,525.50, Gustafson Drainage LLC for $216,680.50, Landwehr Construction, Inc. for $242,678.50, Forsberg Drainage and Excavation for $245,247.00, Ellingson Drainage for $249,669.50, and Land Pride Construction for $257,000.00.

Approved requests of M. Durkee to attend a 1-day concrete field recertification in Owatonna, a 1-day bridge construction recertification in Arden Hills, and a 1-day bituminous street recertification in Mankato; D. Babcock to attend a 1-day bituminous plant recertification in Arden Hills; A. Murphy and C. Vereide to attend a 1-day passport acceptance agent training in Glencoe; G. Paschke to attend a 2-day National Uniform Standards of Professional Appraisal Practice class in St. Cloud; J. Franzen to attend a 1-day bituminous street recertification in Mankato and a 1-day concrete field recertification in Owatonna.

ORDINANCE 2015-12

CITY OF BLUE EARTH

AN ORDINANCE TO AMEND SUBSECTION 1040.04 OF THE CITY CODE

CONCERNING SCREENING OR FENCING

The City Council of the City of Blue Earth does hereby ordain the following: SECTION I.

That Subsection 1040.04, Subd. 11B is hereby amended to state the following:

B. Property Line Screening or Fencing. Screening or fencing shall not be erected within the City of Blue Earth any closer than three (3) feet from the property line. A variance shall be required for placement of screening or fencing closer to the property line. Where the property line is not clearly defined and located, a certificate of survey may be required by the Zoning Administrator or City Administrator to establish the property boundary prior to issuance of a building permit.

SECTION II.

That all other provisions of Subsection 1040.04 are hereby re-affirmed and remain in full force and effect.

SECTION III.

That this Ordinance shall be effective 30 days after its passage and publication.

ORDINANCE 2015-13

CITY OF BLUE EARTH

AN ORDINANCE TO AMEND SUBSECTION 1010.03 OF THE CITY CODE

CONCERNING THE POWERS AND DUTIES OF THE

PLANNING COMMISSION

The City Council of the City of Blue Earth does hereby ordain the following: SECTION I.

That Subsection 1010.03 -Planning Commission is hereby deleted in its entirety and replaced by a new Subsection 1010.03 set forth in Section II hereof.

SECTION II.

That the new Subsection 1010.03- Planning Commission states the following:

1010.03 Planning Commission.

Subd. 1. Variances. The Planning Commission shall review, discuss, advise and recommend action to the City Council for all variance and conditional use permit applications received by the City. The recommendations made by the Planning Commission for both Variances and Conditional Use Permits shall consider and address the definitions set forth in Subsection 1000.06, the conditions set forth in Subsection 1010.09 and the district regulations and performance standards set forth in this Chapter as well as State law.

Subd. 2. Hearings. All hearings of the Planning Commission shall be held within such time and upon such notice to interested parties as provided for in State Statutes. The Planning Commission shall make its recommendations to the City Council in a timely fashion so that action can be taken upon the application before the City Council in the timely fashion as required by State Law.

SECTION III.

That this Ordinance shall be effective 30 days after its passage and publication.

Any objections to the Petition must be filed with the Court prior to or raised at the hearing. If proper, and no objections are filed or raised, the Petition may be granted.

IT IS ORDERED and Notice is further given, that the Petition will be heard on December 8, 2015 at 10:30 a.m. by this Court at 415 North Main Street, Blue Earth, Minnesota.
