ORDINANCE 3.14.16
AN ORDINANCE RELATING TO THE KEEPING OF
CHICKENS IN THE
CITY OF ELMORE
The City Council of the City of Elmore passed Ordinance 3.14.16 on March 14, 2016. This is a summary of the contents of said ordinance for the purposes of publication. A copy of the full test of the ordinance is available for review at Elmore City Hall from the City Clerk during normal business hours. The summary is as follows:
Subdivision 1 – Sets forth the definitions of the text of the new ordinance for the regulation of urban chickens including definitions of chicken, coop, hen, rooster and exercise yard.
Subdivision 2 – Authorizes City Officers to investigate and enforce the provisions of the new ordinance for the purposes of granting, renewing or denying any permits to allow urban chickens. Includes the limitations for the allowance of a permit to single dwelling residential properties in the City. The limitations include the prohibition of roosters, the size of the coop, the size of the exercise yard, the disposal of dead birds and garbage and filth, the storage of grains and food for the animals and climate control provisions.
Subdivision 3 – Requires a permit for the keeping of urban chickens, including the approval of adjoining landowners in writing. Said permit is to be issued by the City.
Subdivision 4 – Requires an application for a permit and sets forth the information necessary for a complete application.
Subdivision 5 – Permit conditions – allows the City Council to set forth specific conditions for each and every permit issued based upon the reasonable requirements necessary to protect any person or neighboring use of property from unsanitary conditions or nuisances to protect the public health and safety.
Subdivision 6 – Allows the City to charge a fee for the permit.
Subdivision 7 – Sets forth the term of a permit for Urban Chickens.
Subdivision 8 – Allows the City to Revoke Urban Chicken permits.
Subdivision 9 – Sets for the penalties for a violation of the ordinance.
