ORDINANCE NO. 16-07
CITY OF BLUE EARTH
AN ORDINANCE TO CONVEY REAL PROPERTY
The City Council of the City of Blue Earth do ordain as follows:
SECTION I
That the City of Blue Earth was the fee owner of certain real property located in the City of Blue Earth on September 8, 1988 and legally described as follows:
A tract bounded by a line commencing at the Southeast corner of Lot 10 in Block 74; thence North 61 feet West 146 feet; thence South 61 feet; thence East 146 feet to point of beginning. (Said tract being also sometimes described as South 61 feet of Lots 8, 9 and 10 in Block 74).
SECTION II
That on or before September 8, 1988, the Blue Earth City Council voted unanimously to convey said real property described in Section I above to Terrance J. Armon and Jane B. Armon and unanimously approved a Warranty Deed for said conveyance to be signed by the Mayor and City Clerk-Administrator on behalf of the City of Blue Earth. Said approved Warranty Deed was signed by Mayor Loren B. Lein and City Clerk-Administrator Patrick Hardy. Said Warranty Deed was delivered in exchange for full consideration on September 8, 1988.
SECTION III
That the City of Blue Earth is a Charter City. The City Charter requires all real estate conveyances be authorized by Ordinance. The City records and the public records do not show that a written document was executed for the September 8, 1988 conveyance specified in Section I and II above herein.
The City Council of the City of Blue Earth now desires to execute and place of record the required Ordinance document for the real property conveyance of September 8, 1988.
That the City Council of the City of Blue Earth, pursuant to Minnesota Statutes 412.211 and the City Charter for the City of Blue Earth hereby retroactively reaffirms and ratifies the actions of the City Council of the City of Blue Earth on September 8, 1998 by hereby authorizing the conveyance of the real property described in Section I herein to Terrance J. Armon and Jane B. Armon by the Mayor and City Clerk-Administrator and acknowledges receipt of payment of the consideration for said conveyance.
SECTION IV.
This Ordinance shall not be effective until thirty (30) days after its passage and publication.

SECTION I.
WHEREAS, on May 12, 2016, Governor Dayton signed into law the creation and regulation of temporary family health care dwellings, codified at Minn. Stat. 462.3593, which permit and regulate temporary family health care dwellings;
WHEREAS, subdivision 9 of Minn. Stat. 462.3593 allows cities to “opt out” of those regulations;
SECTION II.
THE CITY COUNCIL OF THE CITY OF BLUE EARTH, ORDAINS as follows:
That a new Subsection 1020.04 is hereby adopted stating as follows:
1020.04. OPT-OUT OF MINNESOTA STATUTES, SECTION 462.3593. Pursuant to authority granted by Minnesota Statutes, Section 462.3593, subdivision 9, the City of Blue Earth opts-out of the requirements of Minn. Stat. 462.3593, which defines and regulates Temporary Family Health Care Dwellings.
SECTION III.
This Ordinance shall be effective immediately upon its passage and publication.

AN ORDINANCE FOR THE CONVEYANCE OF
REAL PROPERTY
OWNED BY THE CITY
OF BLUE EARTH
The City Council of the City of Blue Earth do ordain as follows:
SECTION I
That the Housing and Redevelopment Authority of the City of Blue Earth is the fee owner of certain real property located in the City of Blue Earth and legally described as follows:
A tract of land in the Southwest Quarter of the Northeast Quarter of Section 20, Township 102 North, Range 27 West, in the City of Blue Earth, Faribault County, Minnesota described as follows:
Commencing at the Southwest corner of the Northeast Quarter of Section 20, Township 102 North, Range 27 West, in Faribault County, Minnesota; thence North 88 degrees 38 minutes 24 seconds East, (assumed bearing) along the centerline of 21st Street and the South line of the Northeast Quarter of Section 20, a distance of 312.50 feet to the point of beginning; thence North 00 degrees 00 minutes 00 seconds West, a distance of 183.00 feet to the south line of Southview Addition according to the plat thereof on file and of record in the office of the County Recorder in the City of Blue Earth, Faribault County, Minnesota; thence North 88 degrees 38 minutes 24 seconds East, along the south line of said Southview Addition, a distance of 100.00 feet to the southeast corner of said Southview Addition; thence South 00 degrees 00 minutes 00 seconds East, along the southerly extension of the east line of said Southview Addition, a distance of 183.00 feet to the south line of the Northeast Quarter of said Section 20; thence South 88 degrees 38 minutes 24 seconds West, along said south line, a distance of 100.00 feet to the point of beginning.
The Southwest corner of the Northeast Quarter of said Section 20 herein referred to and lines adjoining thereto is that location as established by County Surveyor Merle Johnson in 1949 and 1952 more particularly described in Document No. 227328 being the Certificate of Location of said corner by Martin C. Menk, and filed February 24, 1976.
Formerly described as:
A tract commencing at a point 312.5 feet East of the Southwest Corner of the Northeast Quarter of Section 20, Township 102 North, Range 27 West of the Fifth Principal Meridian, Faribault County, Minnesota, running thence North 183 feet, thence East 100 feet, thence South 183 feet, thence West 100 feet to the point of beginning, subject to highway easement.
SECTION II
Carlos A. Rodriguez and Maria M. Rodriguez are desirous of purchasing property in Section I above and the Housing and Redevelopment Authority of the City of Blue Earth is desirous of transferring such property for a price of $13,000.00 and other valuable consideration.
SECTION III
Pursuant to the provisions of Chapter 12, Section 12.02 of the City Charter of the City of Blue Earth, the City of Blue Earth is hereby authorized to sell and the Housing and Redevelopment Authority of the City of Blue Earth is hereby authorized to sell the property described in Section I of this ordinance and the Mayor and City Administrator and the Chairman and Vice Chairman of the Housing and Redevelopment Authority are hereby authorized to convey said real property to the purchaser upon payment of the purchase price.
SECTION IV
This Ordinance shall not be effective until thirty (30) days after its passage and publication.

The regular meeting of the Board of Education of the Blue Earth Area, I.S.D. #2860 was held on Monday, July 11th in Blue Earth, MN.
Present were School Board members: J. Haugh, M. Maher, D. Fellows, F. Bly, S. Ripley, A. Patten and S. Hauskins. Also Attending were Supt. Gough, members of the press, staff and public.
The meeting was called to order at 6:30 p.m. by Chairperson Bly. The Pledge of Allegiance was recited.
On a Haugh/Maher motion, the Board approved the agenda.
Public Input: None
On a Hauskins/Patten motion, the Board unanimously approved the minutes from the June meeting.
Four money transfers were approved in the amount of $2,559,528.64. Maher/Fellows motion.
Action Items
On a Haugh/Ripley motion the Board approved the MSBA 2016-17 membership.
An Addition to the District Phone System was unanimously approved on a Maher/Ripley motion.
The Long Term Facility Maintenance 10 Year Plan was unanimously approved on a Hauskins/Fellows motion.
On A Haugh/Patten motion the Revised Southern Plains Educational Cooperative Joint Powers Agreement was approved.
The Bus Purchase Bids were approved on a Haugh/Maher motion.
The Miscellaneous Pay Rates for 2016-17 were approved. Patten/Ripley motion.
On a Ripley/Maher motion the Activity/Meal Rates for 2016/17 were approved.
The following Board Member Reimbursement Rates were approved on a Haugh/Maher motion:
$600 Annual for Chair and Clerk
$50 per meeting up to 1/2day meeting
$150 per full day meeting

11. Accepted quote for 2016 deicing salt from Mills & Miller of Brandon SD for $75.00 per ton at a total cost of $30,000. Other quotes received were $31,656 from Compass Minerals America, Inc. of Overland Park KS, $31,964 from Cargill, Inc. of North Olmsted OH, $32,804 from Morton International, Inc. of Chicago IL, $33,776 from Central Salt, LLC of Elgin IL, and $37,292 from Independent Salt Company of Kanopolis KS.
12. Approved upgrading electrical service at Pihl’s Park to meet electrical code for an estimated cost of $9,450.
13. Approved solid waste and recycling license for B&B Sanitation and Recycling.
14. Approved contract with Peterson Refuse and Demo for recycling services.
15. Approved payment bills totaling $580,377.10.

NOTICE OF APPLICATION FOR LIVESTOCK FEEDLOT
PERMIT
Notice is hereby given per Minnesota Statutes 116, that Shawn Olson has made application to the Minnesota Pollution Control Agency or the County of Faribault for a permit to construct or expand a feedlot with a capacity of 500 animal units or more.
The proposed feedlot will be located in the NW 1/4 of the NW 1/4 of Section 13, Emerald Township (T. 102N., R. 26 W.), Faribault County, Minnesota. The proposed new facility will consist of 2,400 swine between 55 and 300 pounds housed in a total confinement barn with a poured reinforced concrete pit for manure storage. The total animal unit capacity will be 960 animal units.
This publication shall constitute as notice to each resident and each owner of real property within 5,000 feet of the perimeter of the proposed feedlot as required by Minnesota State Law.
A public meeting will be held on August 16, 2016 at 11:00 a.m. at the Faribault County Board of Commissioner’s meetings at the Faribault County Courthouse for citizen input in regard to the feedlot being permitted.
