In the Matter of: The Redetermination of Benefits of County Ditch #41 and the Petition to Repair County Ditch #41
PLEASE TAKE NOTICE, the Board of Commissioners of the Faribault County sitting as the drainage authority for CD#41 will hold a final hearing on the redetermination of benefits, the viewers’ report of benefits and damages for the redetermination of benefits on County Ditch #41, and the Engineers Repair Report for the Petition for Repair of County Ditch #41. The engineer’s and viewers’ reports were filed with the drainage authority on February 22, 2017 and are available for inspection at the Faribault County Auditor’s Office, 415 North Main, Blue Earth, MN or online at www.co.faribault.mn.us. The hearing shall be held at 1:00 p.m. on March 29, 2017, at Hamilton Hall, 209 S Main St, Blue Earth, MN. At the final hearing, the drainage authority will accept public comment regarding the viewers’ reports for the redetermination of benefits and then accept comments on the engineer’s repair report. Any party having an interest in the proceedings may appear and provide comment. Written comments will be accepted at the hearing and by mail through the date of the hearing at the Faribault County Auditor’s Office, PO Box 130, Blue Earth, MN 56013.
County Ditch 41 Consists of open channel and tile branches and drains part or all of the following sections in Elmore Township; Sections 26, 27, 28, 29, 32, 33, 34, 35 and 36 and part of Rome Township Section 31. The watershed includes all or portions of section 8, 9, 10, 11, 13, 14, 15, 16, 17, 22, 23 and 24 in Hebron Township, Iowa. Expenditures to repair County Ditch #41 are covered by an agreement between Faribault County and Kossuth County. The redetermination of benefits includes the entire CD #41 watershed within Faribault County. The repair project includes the cleaning of the open channel of CD#41 from its outlet in section 29 of Elmore Township to its starting point in section 36 of Elmore Township.
The following properties are affected by the work identified in the engineer’s report and the viewers’ report of benefits and damages:
