In the matter of the Redetermination of Benefits of County Ditch #70;

PLEASE TAKE NOTICE, the Board of Commissioners of the Faribault County sitting as the drainage authority for CD#70 will hold a final hearing on the redetermination of benefits of CD#70. The viewers’ reports were filed with the drainage authority on February 27, 2017 and are available for inspection at the Faribault County Auditor’s Office, 415 North Main, Blue Earth, MN or online at www.co.faribault.mn.us. The hearing shall be held at 2:30 p.m. on March 29, 2017, at Hamilton Hall, 209 S Main St, Blue Earth, MN. At the final hearing, the drainage authority will accept public comment regarding the viewers’ reports for the redetermination of benefits. Any party having an interest in the proceedings may appear and provide comment. Written comments will be accepted at the hearing and by mail through the date of the hearing at the Faribault County Auditor’s Office, PO Box 130, Blue Earth, MN 56013.

Sealed Prime General Contract bids for Blue Earth Area School Roof Renovation will be received by the Owner at the office of the Owner, 315 East 6th Street, Blue Earth, Minnesota 56013 by mail or personal delivery until Thursday, April 20, 2017 at 2:00 p.m. at which date and time the bids will be opened and read aloud.

SYNOPSIS

MARCH 1, 2017

1. Commissioners Groskreutz, Loveall, Warmka, and Young were present. Commissioner Roper was absent. County Auditor/Treasurer/Coordinator John Thompson, Drainage Manager Merissa Lore, Project Engineer Charles Brandel, and Drainage Authority Legal Counsel Kurt Deter were also present. Petitioner’s Attorney Bruce Sellers and Attorneys Erick Kaardal and Todd Ullom of Sambatek representing a landowner also attended.

2. Accepted affidavit of mailing as presented by County Auditor/ Treasurer/Coordinator Thompson.

3. Drainage Authority Attorney Kurt Deter explained the reason for a preliminary hearing.

4. Project Engineer Charles Brandel reviewed the preliminary engineers report.

5. County Auditor/Treasurer/ Coordinator John Thompson read the Department of Natural Resources preliminary advisory letter dated February 28, 2017.

6. Attorney Erick Kaardal representing Charles Carlson, Steve Zebedee, and Cesar Larson appeared during public comment.

7. Accepted engineer’s report and direct staff to draft an order that the drainage authority finds that the proposed drainage project outlined in the Petition and modified by the board and recommended by the engineer is feasible, that there is a necessity for the drainage project, that the proposed drainage project will be of public benefit and promote the public health, after considering the environmental and land use criteria in Section 103E.015, Subd.1. and that the outlet is adequate.

8. Directed engineer to consider the following in the final survey report: Effect on plan due to the elimination of the land north of the county road 14, how Branch B will be incorporated into the system, include discussion of overland flow of water due to the abandonment of the grass waterway that is planned, and to ask legal counsel to address concerns brought forward by Charles Carlson’s attorney.

9. Directed staff to draft order appointing the following viewers to view the project: Chris Christenson, Mark Behrends, Robert Hanson, and Dennis Distad.

10. Directed staff to address issue of obstructions in County Ditch 24’s shallow open ditch and report back to the drainage authority with a synopsis of the recent proceedings on CD24.

8. Approved requests from M. Lore and Z. Coxworth to attend a 1-day Mn Association of Drainage Inspectors annual meeting in Willmar, L. Rebuffoni to attend a 3-day Mn Association of County Feedlot Officers annual conference in Moorhead, B. Shimmon to attend a 3-day Mn County Highway Accountants conference in Alexandria.

9. Approved payment bills totaling $844,461.47.
