It is Ordered and Notice is given that on November 17, 2020, at 10:50 AM, a hearing will be held by Zoom with this Court at 415 N. Main Street, Blue Earth, Minnesota, for the formal probate of an instrument purporting to be the Will of the Decedent dated, November 22, 2016, and codicils to the will, dated January

10, 2017, (“Will”), and for the appointment of Maria Rosario G. Anderson, whose address is 2175 Waterton Rivers Drive, Henderson, NV, 89044 as Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration. Any objections to the petition must be filed with the Court prior to the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.

ORDINANCE NO. 20-02

CITY OF BLUE EARTH

AN ORDINANCE TO CONVEY A TRACT OF REAL

PROPERTY OWNED BY THE CITY OF BLUE EARTH

FROM THE ECONOMIC

DEVELOPMENT AUTHORITY TO APX CONSTRUCTION GROUP, LLC.

The City Council of the City of Blue Earth do ordain as follows:

SECTION I

The City of Blue Earth and the Economic Development Authority of the City of Blue Earth own certain property located in the City of Blue Earth legally described as follows:

Lot 1, Block 2 of Prairie View Addition in the City of Blue Earth, Faribault County, Minnesota according to the recorded Plat thereof in said County.

And

Lot 2, Block 2 of Prairie View Addition in the City of Blue Earth, Faribault County, Minnesota according to the recorded Plat thereof in said County.

SECTION II

APX Construction Group, LLC is desirous of purchasing the real property described in Section I above and the City of Blue Earth and the Economic Development Authority of the City of Blue Earth are desirous of selling said real property for a sale price of $36,500.00.

SECTION III

Pursuant to the provisions of Chapter 12, Section 12.02 of the City Charter of the City of Blue Earth, the City of Blue Earth is hereby authorized to sell and the Economic Development Authority of the City of Blue Earth is authorized to sell the real property described in Section I above and the Mayor and City Administrator and the President and Vice President of the Economic Development Authority are authorized to convey said real property to the purchaser upon payment of the purchase price.

SECTION V

This Ordinance shall not be effective until thirty (30) days after its passage and publication.

NOTICE OF HEARING ON PROPOSED ASSESSMENT

Winnebago, Minnesota

October 19th, 2020

TO WHOM IT MAY CONCERN:

Notice is hereby given that the council will meet at 6:00 p.m. on November 10th, 2020 at City Hall to consider, and possibly adopt, the proposed assessment for the Northwest Area Street and Utility Improvements. Adoption by the council of the proposed assessment against abutting property may occur at the hearing.

Such assessment is proposed to be payable in equal annual installments extending over a period of 20 years, the first of the installments to be payable on or before the first Monday in January 2021, and will bear interest at the rate of 2.0 percent per annum from the date of the adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2020. To each subsequent installment when due shall be added interest for one year on all unpaid installments.

You may at any time prior to certification of the assessment to the county auditor, pay the entire assessment on such property, with interest accrued to the date of payment, to the City Administrator. No interest shall be charged if the entire assessment is paid within 30 days from the adoption of this assessment. You may at any time thereafter, pay to the county auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is 2.0 percent per year. The right to partially prepay the assessment is available.

The proposed assessment roll is on file for public inspection at the city administrator’s office. The total amount of the proposed assessment is $1,273,539.52. Written or oral objections will be considered at the meeting. No appeal to district court may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable.

Under Minn. Stat. §§ 435.193 to 435.195, the council may, in its discretion, defer the payment of this special assessment for any homestead property owned by a person 65 years of age or older, one retired by virtue of a permanent and total disability, or a member of the National Guard or other reserves ordered to active military service for whom it would be a hardship to make the payments. When deferment of the special assessment has been granted and is terminated for any reason provided in that law, all amounts accumulated plus applicable interest become due. Any assessed property owner meeting the requirements of this law, may, within 30 days of the confirmation of the assessment, apply to the city administrator for the prescribed form for such deferral of payment of this special assessment on his/her property.

An owner may appeal an assessment to district court pursuant to Minn. Stat. § 429.081 by serving notice of the appeal upon the mayor or administrator of the city within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the mayor or administrator.

NOTICE OF PUBLIC HEARING CITY OF WINNEBAGO

Notice is hereby given that the Winnebago City Council will hold a public hearing for the purposes of considering a petition for an alley vacation located on Block 31 on 3rd and 4th Ave. SW. The recommendation from the Planning Commission stated that the Western half of the alley be vacated, and extension of the Eastern half should be made to the center of the block as marked by the utility pole. A permanent easement of 12 ft. is to remain all through said alley. The City of Winnebago will be responsible for procuring an easement of 5 ft. on parcels 312003980 and 312003900 to extend a turn-around. All property owners affected by the proposed vacation shall be responsible for the recording and surveying costs associated with the change in status of the alley. This meeting and public hearing will be held at 7:00 p.m. on November 10th, 2020 in the city hall located at 140 Main Street South in Winnebago.

All persons who wish to express their opinions regarding this proposed alley vacation can do so at this meeting. Written comments may also be sent to the Municipal Center, PO Box 35, Winnebago, MN 56098.
