NOTICE AND ORDER OF HEARING ON PETITION FOR PROBATE OF WILL AND

APPOINTMENT OF PERSONAL REPRESENTATIVE AND NOTICE TO CREDITORS (ANCILLARY PROCEEDING)

It is Ordered and Notice is given that on May 18, 2021, at 10:30 a.m., a hearing will be held in this Court at 415 North Main Street, Blue Earth, Minnesota, for the formal probate of an instrument purporting to be the Will of the Decedent dated, September 1, 2016, (“Will”), and for the appointment of Nathan E. Tesch, whose address is PO Box 13055, Des Moines, WA 98198 as Ancillary Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with power to administer the assets of the Estate in Minnesota including the power to collect all assets, pay all legal debts, claims, taxes and expenses, and sell real and personal property, and do all necessary acts for the Estate. This hearing will be held by Zoom. Contact the court for instructions to appear.

Notice is also given that (subject to Minnesota Statutes section 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

NOTICE AND ORDER FOR HEARING ON PETITION FOR DESCENT OF PROPERTY

A Petition for Determination of Descent has been filed with this Court. The Petition represents that the Decedent died more than three years ago, leaving property in Minnesota and requests the probate of Decedent’s

last Will (if any), and the descent of such property be determined and assigned by this Court to the persons entitled to the property.

Any objections to the Petition must be filed with the Court prior to or raised at the hearing. If proper, and no objections are filed or raised, the Petition may be granted.

IT IS ORDERED and Notice is further given, that the Petition will be heard on May 18, 2021, at 10:30 a.m., by this Court at 415 N. Main St., Blue Earth, Minnesota. This hearing will be held by Zoom.

1. Notice shall be given to all interested persons (Minn. Stat. § 524.1-401) and persons who have filed a demand for notice pursuant to Minnesota Statutes section 524.3-204.

2. Notice shall be given by publishing this Notice and Order as provided by law and by: Mailing a copy of this Notice and Order at least 14 days prior to the hearing date.

Approved synopsis and official proceedings of the March 2, 2021 regular and drainage authority meetings.

Approved agenda of March 16, 2021.

No member of the public met during public comment.

Approved Resolution 21-CB-29 approving 5-year capital improvement bonding project as presented. All voted yes.

Approved hiring Benjamin Bromeland as Public Works Shop Mechanic.

Approved Faribault County cover 1/3 of the total cost of $1,500.00 to correct pavement around a structure owned by Huntley Sewer District on County Road 1. Loveall voted no.

Accepted sole bid for SP 022-598-010 for 2021 bridges of $2,005,520.98 from ICON Constructors contingent on Office of Civil Rights certification.

Accepted low bid for CP 21-600-10 for 2021 striping of $88,225 from Traffic Marking Services. Other bids received were from AAA Striping for $89,000.00 and from Sir Lines-A-Lot for $90,950.00.

Accepted low bid for SAP 022-599-121 replacing Bridge L9793 for $324,365 from Midwest Contracting. One other bid was received from Landwehr Construction for $344,505.00.

Accepted low bid for CP 21-600-01 for 2021 seal coat oil of $317,800 from Flint Hills Resources. One other bid was received from H G Meigs for $332,416.00.

Accepted low bid for CP 21-600-20 for 2021 crack sealing of $29,896.23 from Fahrner Asphalt. Other bids received were from Lot Pros for $37,183.00, MP Asphalt for $42,285.00, Northwest Asphalt for $56,212.00, ASTECH for $62,016.50, and Allied Blacktop for $81,812.90.

Approved Resolution 21-CB-30 for the repurchase of tax forfeited property Parcel No. 31.200.5640 in the City of Winnebago. All voted yes.

Approved Resolution 21-CB-31 to sell Parcels No. 31.200.6980 and 31.200.3060 to the City of Winnebago to correct blight. All voted yes.

Approved request from B. Gehrking to attend a 5-day Law Enforcement K-9 seminar in Independence IA.

Approved requests from M. Murphy, J. Casias, T. Bonin, and M. Sonnek to participate in a 1-day online Corrections Training for Jail Staff.

Approved opening east Courthouse entrance no later than April 6, 2021 with the understanding the entrance will be temporarily closed if a snow event then happens after the entrance is officially opened.

Approved payment of the following bills: Auditor warrants totaling $1,802,502.50, ACH-EFT payments totaling $1,429,568.06; and audit/auxiliary totaling $305,774.41.

Accepted low bid of $3,799,437.47 on SP 002-601-025 for 2021 overlays from Ulland Brothers. Other bids received were: $4,489,130.57 from Knife River, $4,698,653.02 from Minnesota Paving, $4,706,683.48 from Central Specialties, and $4,849,170.92 from Duininck, Inc.

Approved Resolution 21-RB07-33 an agreement with Minnesota Department of Natural Resources maintenance and grooming of the snowmobile trails. All voted yes.

Approved Resolution 21-RB08-34 for a grant from the Minnesota State Transportation Fund for construction of Bridge No.22623 on CR 109. All voted yes.

Approved Resolution 21-RB09-35 a grant from Minnesota State Transportation Fund for construction of Bridge No. 22J58 on CSAH 9. All voted yes.

Approved Resolution 21-RB10-36 a grant from Minnesota State Transportation Fund for construction of Bridge No. 22622 on CSAH 21. All voted yes.

Closed meeting for attorney-client privilege regarding CD21 litigation. County Attorney Karjala reviewed closed session.

Approved full depth reclamation with bituminous overlay on CSAH 31 at a total cost of $3,135,799.00.

Approved Resolution 21-CB-37 approving State of Minnesota Joint Powers Agreement on behalf of Faribault County Attorney and Sheriff. All voted yes.

Approved subordination of an SSTS loan to Ryan and Angela O’Hara recorded on September 9, 2016 as Document No. 372458 to First Bank of Blue Earth.

Approved training request from M. Sonnek for a 1-day Minnesota Jail Programs and Services spring training day online.

Recessed to drainage authority meeting.

Approved Resolution 21-RB11-37 amending a request of an advance of County State Aid Highway funds to up to $3,832,654.00 from the Commissioner of Transportation. All voted yes.

Approved payment of bills totaling $484,431.98.
