SUMMONS

THE STATE OF MINNESOTA TO THE DEFENDANT ABOVE NAMED:

1. YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is attached to this summons. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this summons.

2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this summons located at PATTON HOVERSTEN & BERG PA 302 First Avenue N.W., Faribault, Minnesota, 55021; Fax: 507-331-7421; Email: john.scott@phblawoffice.com.

3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not Answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the complaint. If you do not want to contest the claims stated in the complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the complaint.

5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.

6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.

Main Street, Blue Earth, Minnesota, for the formal probate of an instrument purporting to be the Will of the Decedent dated, September 3, 2013, and codicils to the will, dated October 2, 2018, (“Will”), and for the appointment of Janet R. Peterson, whose address is P. O. Box 385, Bricelyn, MN, 56014 as Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate. PUBLIC HEARING

Notice is hereby given that the The City of Winnebago will hold a Public Hearing on August 10th, 7:00 p.m., at the Municipal Center.

This will be an informational meeting to discuss the purchase of a new police vehicle, including economic and environmental impacts, service area, alternatives to the project, and potential funding sources, including USDA Rural Development. All residents and property owners within the City of Winnebago are encouraged to attend.

NOTICE OF PUBLIC HEARING

Notice is hereby given that The Faribault County Planning Commission will hold a Public Hearing on Monday, August 9th, at 7:00 PM in the Conference Room of the Faribault County Ag. Center, Blue Earth, Minnesota, to consider the following amendments: Zoning Ordinance Section 6 – A-1 Shoreland Ag District & Section 7 – A-2 Ag District, to reduce the minimum setback to the Ordinary High Water Level (OHWL) and, consider the requirement for two family dwellings to acquire a CUP. The Planning Commission may also continue to hear public comment on a potential nuisance/junk ordinance.

It is the purpose of the ordinance to promote the health, safety, morals, and general welfare of the citizens of Faribault County.

All interested parties are invited to attend.

1. Anderson, Groskreutz, Roper and Young were present. Loveall was absent. Pledge of allegiance was recited.

2. Approved synopsis and official proceedings of the June 15, 2021 regular, drainage authority and Board of Equalization meetings.

3. Approved agenda of July 6, 2021.

4. A public hearing on food and beverage ordinance was held at 9:30 a.m. No member of the public appeared to make comment.

5. Adopted Resolution 21-CB-54 the amended food and beverage ordinance and repeal former. All voted yes.

6. A public hearing on swimming pool ordinance was held at 9:35 am. No member of the public appeared to make comment.

7. Adopted Resolution 21-CB-55 the amended swimming pool ordinance and repeal the former. All voted yes.

8. Adopted Resolution 21-RB12-56 approving the grant agreement for Blue Earth Safe Routes to Schools program. All voted yes.

9. Adopted Resolution 21-RB13-57 approving the agreement to maintain facility for Blue Earth Safe Routes to Schools program. All voted yes.

10. Approved to temporarily fill void on JD1F crossing at CSAH 13 with adequate patch until permanent repair can be made. Groskreutz voted no.

11. Rescinded authorization of the County Coordinator to cast a unanimous vote for Mary Jo McGuire as second vice president of the National Association of Counties.

12. Approved hiring of Anthony Alleven as Maintenance Man I in Public Works; Tanya Nichols as Part-time Dispatch/ Jailer, Tiffany Cumming as Part-time Deputy, and Dalton Potter as full-time Dispatch/Jailer in the Sheriff Department; Stacy Scofield as Administrative Office Specialist in Court Services; and Saxon Warmka as Building/Facilities Maintenance Assistant in Buildings and Grounds.

13. Accepted quote of $94,785.00 for replacement of JD1F centerline culvert on CSAH 13 from Brunz Construction.

14. Approved purchase a used large format plotter/scanner for $1,500.00 using Recorder Compliance Funds.

15. Approved Resolution 21-CB-58 setting public landowner tax forfeiture auction date and Parcel List 2021-B to 9:00 a.m. Tuesday, August 10, 2021. All voted yes.

16. Approved Resolution 21-CB-59 setting private adjacent landowner tax forfeiture auction date and Parcel List 2021-A to 9:00 a.m. August 6th in commissioners board room. All voted yes.

17. Approved requests from M. Lore to attend an online Supervisor Coaching lab; L. Scholten to attend a one-day Labor Law & Labor Arbitration in Minneapolis; T. Hanevik to attend a 4-day Jail Administrators Conference in Brainerd; M. Eckhardt to attend a 1-day Minnesota Prosecutor training in Minneapolis; and L. Mehrhof to attend a 2-day MN Assoc. of Assessment Personnel in St. Cloud.

18. Approved credit card for Cameron Davis.

19. Set 2022 budget work session at 9:00 a.m. on August 24, 2021.

20. Approved placing ad in Faribault County Register special fair edition.

21. Approved payment of bills totaling $507,495.24.

Discussion was held concerning the following:

1. T. Langer met regarding public health ordinances.

2. M. Daly met regarding public works business.

3. L. Scholten met regarding central services business.

4. D. Anderson met regarding drainage business.

The meeting was recessed to July 20, 2021.
