AN ORDINANCE GRANTING CENTERPOINT ENERGY RESOURCES CORP., d/b/a/ ENTERPOINT ENERGY MINNESOTA GAS (“CENTERPOINT ENERGY”), ITS SUCCESSORS AND ASSIGNS, A NON-EXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE, REPAIR AND MAINTAIN A GAS DISTRIBUTION SYSTEM INCLUDING NECESSARY GAS MAINS, PIPES AND EQUIPMENT FOR THE TRANSPORTATION, DISTRIBUTION AND SALE OF GAS FOR PUBLIC AND PRIVATE USE AND TO USE PUBLIC WAYS AND PUBLIC GROUNDS OF THE CITY OF WINNEBAGO FOR SUCH PURPOSES; AND PRESCRIBING CERTAIN TERMS AND CONDITIONS THEREOF.
The following is the official summary of Ordinance No. 1, second series to be approved by City Council on Tuesday, January 13, 2023. The purpose of the ordinance is to grant to CenterPoint Energy a 20 year non-exclusive franchise to operate, repair and maintain a natural gas distribution system within the city limits of the City of Winnebago. The terms and conditions of service and the rates to be charged by CenterPoint Energy for natural gas energy are subject to the exclusive jurisdiction of the Minnesota Public Utilities Commission. The ordinance provides for a method of dispute resolution if either the City of Winnebago or CenterPoint Energy asserts that the other party has defaulted in the terms of the gas franchise ordinance. The ordinance provides that all gas facilities shall be located, constructed, and maintained so as not to interfere with the safety and convenience of ordinary travel along and over public ways.
The ordinance also provides that CenterPoint Energy shall indemnify and hold the City of Winnebago harmless from liability on account of injury to persons or damage to property occasioned by the construction, maintenance, repair, inspection, the issuance of permits or the operations of the Gas Facilities located in the City of Winnebago’s public rights of way and public grounds.

ADVERTISEMENT FOR BIDS
Sealed bids or electronic bids will be received by the General Manger of Blue Earth Light & Water, at 125 East 7th Street Blue Earth, Minnesota, 56013, until 1:30 p.m. on the 9th day of February, 2023, for Furnishing 15 kV Switchgear and Control Panels for Blue Earth Light & Water, at which time the bids shall be publicly opened and read aloud.
There are two (2) separate bids consisting of the following:
Bid No. 1 – A new lineup of 15 kV indoor metalclad switchgear including seven (7) vacuum circuit breakers, with related relaying, controls, accessories, and detailed drawings.
Bid No. 2 – Eight (8) new control panels including relaying, controls, accessories, and detailed drawings.
The above equipment shall be in accordance with the specifications and proposed form of contract now on file in the office of the Blue Earth Light & Water, Blue Earth, Minnesota, by this reference made a part hereof as though fully set out and incorporated herein.
All bids shall be made on bid forms furnished by the Engineer and shall be accompanied by bid security in the form of a certified check or bid bond, made payable to Blue Earth Light & Water, Minnesota, in the amount of ten percent (10%) of the bid, which security becomes the property of Blue Earth Light & Water in the event the successful bidder fails to enter into a contract and post a satisfactory Performance Bond.
Material suppliers desiring a copy of the proposal forms and specifications for individual use may obtain them from the office of DGR Engineering, Rock Rapids, Iowa, telephone (712) 472-2531, fax (712) 472-2710, website www.dgr.com, e-mail dgr@dgr.com, no deposit required.
Payment to the Supplier for the equipment shall be made on the basis of ninety percent (90%) of the contract price for the equipment after installation. The final ten percent (10%) of the contract shall be paid within thirty-one (31) days after final completion, field testing, required test reports, record drawings, final documentation and certification by Engineer.
The delivery date for the control panels is desired to be no later than January 26, 2024 and 15 kV switchgear is desired to be no later than March 1, 2024.
Blue Earth Light & Water reserves the right to defer acceptance of any proposal for a period not to exceed thirty (30) days after the date proposals are received and no proposal may be withdrawn during this period. Blue Earth Light & Water also reserves the right to reject any or all bids and enter into such contract as it shall deem to be in the best interest of the Utility.

4. Approved agreement with the State of MN and lessee AT&T to allow AT&T to place a cell antenna on the tower located at the LEC.
5. Approved updated land lease agreement with the State of Minnesota extending the terms to 2039.
6. Approved the updated fee schedule for civil process to match rest of 5th district effective December 8, 2022.
7. Approved renewing the annual contract with CEDA for Faribault County EDA services.
8. Directed CEDA to return unspent funds of $5,000 from 2022 to the county general fund.
9. Approved a waste hauling license for Dulas Disposal for December 2022.
10. Approved signing CSAH 16 for 60mph from west of Blue Earth to the Martin County line.
11. Approved a contract with Beacon to add twelve additional layers on the Beacon website map for assessor’s office use at a cost of $2,352 for 2022 and $1,416 annually thereafter.
12. Approved request to issue a county credit card to Pam Krill, Central Services Director.
13. Approved designation of unspent 2022 funds to be spent in 2023 in the amount of $499,000 for two Mack tandem dump trucks with snowplow equipment.
14. Approved a 3% general wage increase (cost of living adjustment) effective January 1st, 2023 for non-union employees of Faribault County.
15. Approved a gambling permit for Heartland-Faribault County Pheasants Forever to operate bingo and a raffle on February 25, 2023.
16. Appointed David Roper to the County EDA board for a six-year term beginning 1/1/2023.
17. Tabled changing the county board meeting location during January and February 2023 due to courthouse construction.
18. Approved the federal Help Americans Vote Act phase #2 election grant agreement in the amount of $4,286.94 for improvements to federal elections.
19. Approved courthouse HVAC carpentry change order #1 for wood paneling removal at a savings of $242.
20. Approved courthouse HVAC demolition change order #2 for wood paneling removal at a cost of $242.
21. Approved courthouse HVAC abatement change order #2 with Sterling Systems for additional abatement work in the amount up to $130,500.
22. Approved seven courthouse HVAC project pay applications as listed.
23. Approved courthouse HVAC abatement pay application #1 in the amount of $238,448 to Sterling Systems, Inc.
24. Set 9:00 am January 3, 2023 as the date in which to accept bids through to become the official county newspaper for 2023.
25. Adopted Resolution 22-CB-84 setting the 2023 Ditch Levy assessments. All voted yes.
26. Adopted Resolution 22-CB-85 allowing Darren Esser and Kathryn Anderson to make electronic funds transfers on behalf of Faribault County for a period of one year. All voted yes.
27. Approved training requests from J. Oswald to attend a Bridge Safety Inspection Refresher course in Rochester, and S. Van Moer to attend an online Meeting Minutes and the Role of the Clerk training.
28. Approved payment of the following bills: audit/auxiliary totaling $1,074,733.41.
