THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.

YOU ARE HEREBY NOTIFIED THAT:

1. Default has occurred in the conditions of the mortgage dated April 17, 2002, executed by Jenny M. Tucker (Berry), a married person, as Mortgagor(s), to Valley Bank, a Minnesota banking corporation, as Mortgagee(s), and filed for record April 24, 2002, in the Office of the County Recorders, Faribault County, Minnesota (the “Recorder”) as document number 316520, as amended by that certain Note and Mortgage Modification Agreement dated July 1, 2005, recorded on August 3, 2005 with the Recorder as document number 332928, as amended by that certain Note and Mortgage Modification and/or Extension Agreement dated May 28, 2009, recorded on May 29, 2009 with the Recorder as document number 348029, as extended pursuant to that certain Extension of Mortgage dated January 7, 2015, recorded February 2, 2015 with the Recorder

3. The maximum principal amount secured by the Mortgage

was: $43,339.29.

4. No action or proceeding at law is now pending to recover the debt secured by the Mortgage, or any part thereof.

5. The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage, and all notice and other requirements of applicable statutes.

NOTICE is hereby given that SEALED BIDS will be received at until 10:00 AM on Thursday, August 10, 2023 by Jessica Blair, County Auditor-Treasurer of Faribault County, at the Faribault County Courthouse, 415 North Main St., Blue Earth, Minnesota, 56013, on behalf of the Board of County Commissioners of said county for the following project. Bids will be opened and read publicly in the Commissioners Room in the Courthouse in Blue Earth immediately after the hour set for receiving bids. Any bids received after said hour will be returned to the bidder unopened. Any bid received without a certified check or bid bond will be returned without being read or considered.

CITY OF BLUE EARTH

PUBLIC NOTICE

The Blue Earth Planning Commission has scheduled a hearing at 4:00 p.m. on Monday, July 31, 2023, in the Council Chambers of City Hall to consider the following request of Dennis Tesch 410 N. Gorman Street, Blue Earth, MN.

1) Request to waive the 5 ft side yard setback restrictions for the construction of a garage in an R-1 residential district. Application is to build a two-stall garage on property line.

The property is legally described as the North 67 feet of the West Half of Lot Seven (7) in Block Thirty-four (34) as designated upon the Plat of in the Blue Earth City (Now City of Blue Earth), Faribault County, Minnesota on file and of record in the Register of Deeds (Now County Recorder) of said County.

The Planning Commission recommendation will proceed to consideration at the Regular City Council meeting held on Monday, August 7, 2023, at 5:00 P.M. All interested persons are welcome to attend.

JUNE 20, 2023

1. All members present. The pledge of allegiance was recited.

2. Approved synopsis and official proceedings of the June 6, 2023 regular and drainage meetings.

3. Approved amended agenda of June 20, 2023.

4. Approved Resolution 23-PZ06-52 approving the Conditional Use Permit for John and Georgiann Pfaffinger and Invenergy Solar Development LLC. Groskreutz, Roper, Young, and Anderson voted yes. Loveall abstained.

5. Approved Resolution 23-PZ07-53 approving the Conditional Use Permit for Alan Miller – Prairieview Swine LLC, amending Condition #2 to 1380 AU, updating the owner’s name and removing the maintenance fee. Groskreutz, Roper and Anderson voted yes, Young and Loveall voted no.

6. Approved an SSTS grant in the amount of $3,000 and loan in the amount of $15,550.90 to Melisse Storvick for parcel #17.007.0502 located in Seely Township.

7. Approved the low bid of $396,313 from Subsurface for 2023 Culvert Lining Projects SAP 022-613-029 and SAP 022-621-030.

8. Approved the engineer to advertise for annual fuel bids.

9. Approved temporarily assigning the duties of County Coordinator to Mark Daly as of June 24, 2023.

10. Approved setting a work session for Tuesday, July 25, 2023, at 1:00 pm in the boardroom to discuss separation of the coordinator role.

11. Approved taking no further action on converting the office of the County Auditor/Treasurer to appointed at this time.

12. Approved a leave of absence for Jessica Blair as Chief Deputy Auditor.

13. Approved the hire of Jessica Blair as County Auditor/Treasurer effective June 24, 2023.

14. Approved Resolution 23-CB-54 appointing Jessica Blair as deputy registrar of motor vehicles in Faribault County. All voted yes.

15. Approved training requests from B. Ziegler to attend an Intimate Partner Violence Training in St. Cloud; L. Frommie to attend an Association of MN Emergency Managers Conference in Breezy Point; V. Do to attend an online Body Worn Cameras – Legal Issues class; and L. Mehrhof to attend a 2023 MN Association of Assessment Personnel Workshop in Duluth.

16. Approved payment of the following bills: Auditor warrants totaling $2,854,122.15, ACH-EFT payments totaling $2,662,078.85; and audit/auxiliary totaling $235,978.08.

17. Appointed Commissioner Young temporarily to the Personnel Committee through July 9, 2023.

1. Commissioners Groskreutz, Roper, and Young were present. Commissioner Anderson appeared via interactive technology. Commissioner Loveall was absent. The pledge of allegiance was recited.

2. Approved amended agenda of June 27, 2023.

3. Accepted the letter of resignation from Jessica Blair as Auditor/Treasurer effective August 10, 2023. All voted yes.

4. Approved Resolution 23-CB-57 to schedule and hold a public meeting on July 18, 2023, at 9:15am in the boardroom. All voted yes.

5. Approved Resolution 23-CB-58 directing the publication of the notice of intent to establish the appointed office of the Auditor/Treasurer. All voted yes.

Discussion was held concerning the following:

1. B. Hillery met virtually to discuss the process to move the office from elected to appointed.

IT IS HEREBY ORDERED, and notice is given that Petitioner Steven Scheid’s Amended Petition invoking the Court’s in rem jurisdiction shall be heard on August 21, 2023 at 9:00 a.m. before the Honorable Judge Darci J. Bentz, Faribault County District Courthouse, 415 N. Main, Blue Earth, MN 56013.

IT IS FURTHER ORDERED that Trustee Bruce Christopherson shall publish notice of this Order for Hearing in compliance with Minn. Stat. § 501C.0203, subd. 1, and that Petitioner shall serve by U.S. mail a copy of the Amended Petition, along with a copy of this Order for Hearing, on the current trustee and qualified beneficiaries of the trust at least 15 days prior to the hearing, unless waived in writing by such parties.

All objections must be made in writing and filed with the Court at least seven (7) days prior to the hearing on petition. Failure to file and serve a written objection in the time provided will result in waiver of any objection to the Court assuming in rem jurisdiction and the Court will deem the Amended Petition unopposed.
