PLEASE TAKE NOTICE, the Joint Drainage Authority for Faribault and Martin Counties, sitting as the drainage authority for Judicial Ditch #4 will hold a final hearing on the pending Petition for Improvement, the engineer’s detailed survey report, and the viewers’ report of improvement benefits and damages for Judicial Ditch #4. The engineer’s and viewers’ reports were filed with the drainage authority on July 12th, 2023, and May 15th, 2025, and are available for inspection at the Faribault County Auditor’s Office, 415 North Main Street, Blue Earth, MN 56013. The proposed drainage project involves a petition for improvement to Judicial Ditch #4. This petitioned improvement includes enlarging tile diameters of the main tile east of County Road 1 in Faribault County. The project involves installation of approximately 145 linear feet of 6 inch tile, 1,864 linear feet of 8 inch tile, 1,831 linear feet of 10 inch tile, 895 linear feet of 12 inch tile, 33 linear feet of 15 inch tile, 408 linear feet of 18 inch tile, 3,890 linear feet of 24 inch tile, 2,200 linear feet of 36 inch tile, and a wetland restoration. The proposed project outlets into Judicial Ditch #2 in the northeast quarter of the northeast quarter of section 18 of Jo Daviess Township in Faribault County.

WHEREAS, the City Council of the City of Blue Earth, Minnesota has received numerous complaints concerning the nuisance conditions that currently exist upon the real property you own in the City of Blue Earth at 517 E. 6th Street, Blue Earth, MN 56013 and legally described as follows:

WHEREAS, the City of Blue Earth had your real property visually inspected for nuisance conditions by City staff from the public right of way; and

WHEREAS, a copy of the reports of the City staff including photographs, is attached hereto as Exhibit “A;” and

WHEREAS, said reports and photographs confirm the allegations made by numerous citizens concerning the existence of conditions on said real property relating to the proper maintenance of the exterior of the dwelling upon your real property.

NOW THEREFORE, the City Council of the City of Blue Earth makes the following:

FINDINGS OF FACT

1.That nuisance conditions exist upon your real property in violation of Blue Earth City Code Subsections 530.04 in that you currently have violations of said subsections as set forth in the Notice of Violation dated March 18, 2025, attached hereto as Exhibit “A”; and

2.That nuisance conditions in violation of Blue Earth City Code Subsections specified in paragraph 1 above exist upon your property as set forth in the report of the Blue Earth City Staff; and

3.That the conditions described in the staff’s report are of such a nature that it is hereby found that a violation of the Blue Earth City Nuisance Code does exist upon your property; and

4.The City of Blue Earth hereby finds that the nuisance conditions are of such a nature that they require abatement to protect the health and safety of the public of the City of Blue Earth.

NOW THEREFORE, the City Council of the City of Blue Earth does hereby issue the following:

1.That you shall take actions to abate the nuisance conditions upon your real property located on the property legally described above in violation of Blue Earth City Code Subsections 530.04 by June 30, 2025.

2.That you shall take actions to clean up the nuisance issues upon said property as set forth in the staff’s report attached hereto by June 30, 2025.

3.That if the necessary abatement measures are not completed by said date, the City shall seek an Order for Summary Enforcement of its nuisance code in District Court.

This Order was passed by a vote of 5 to 0 on June 2, 2025.

4. Approved allowing the American Legion to utilize part of the old city hall property for the upcoming benefit event on June 21 with the advice of the county attorney.

5. Approved the Region 1 Joint Powers Agreement for Emergency Management.

6. Approved the list of tax-forfeited parcels to be offered for public sale and authorizing the Auditor-Treasurer to amend the list by adding parcels if needed.

7. Approved the Joint Powers Transit Service Agreement as presented.

8. Approved funding for Faribault County’s STS program creation.

9. Approved the training request from A. Salinas to attend Minnesota Deputy Registrar Association Meeting in St. Paul.

10. Approved the training request from T. Doering to attend the Minnesota County Engineers Summer Conference in Alexandria.

11. Approved payment of bills totaling $494,995.16.
