Notice of Application for a Livestock Feedlot Permit

Notice is hereby given per Minnesota Statutes, Chapter 116, that Thomas Ward has made an application to the Minnesota Pollution Control Agency / County of Faribault for a permit to construct or expand a feedlot with a capacity of 500 animal units or more.

The existing site is located in the NE 1/4 of section 2, of Winnebago City township of Faribault County. There is currently one existing barn on the site. Barn 1 (north) is an existing total confinement barn with a below barn concrete manure storage area. The barn has a capacity of 2,499 head of swine weighing between 55 and 300 pounds or 749.7 animal units. Barn 2 (south) is proposed barn will be a total confinement barn with a below barn concrete manure storage area. The barn has a capacity of 2,499 head of swine weighing between 55 and 300 pounds or 749.7 animal units. After construction, this site will have a total of 1,499.4 animal units.

This publication shall constitute as notice to each resident and each owner or real property within 5,000 feet of the perimeter of the proposed feedlot as required by Minnesota State Law.

2. Approved synopsis and official proceedings of the June 3, 2025 regular, drainage and joint drainage meetings.

3. Approved agenda of June 17, 2025.

4. No public comment was received.

5. Approved the hire of Jason Casias as Assistant Jail Administrator.

6. Approved the low bid from Holtmeier Construction, Inc. in the amount of $3,294,133.75 for the CSAH 56 Bricelyn Main Street project.

7. Approved Resolution 25-RB04-22 for the CSAH 19 Bridge 22511 replacement grant agreement. All voted yes.

8. Approved Resolution 25-PZ02-23 for a Conditional Use Permit to StateLine Cooperative for a bulk anhydrous ammonia plant. Commissioners Anderson, Groskreutz, Loveall, and Young voted yes, Paschke voted no.

9. Approved Resolution 25-PZ03-24 for a Conditional Use Permit to Betty and Sonny Berg for a cannabis microbusiness with a retail operations endorsement. All voted yes.

10. Approved the purchase of a dump trailer for the low quote of $8,869.25 from Yeager Implement and adding a protective coating for the estimated amount of $1,000.

11. Approved a bid in the amount of $1,000 to the State of Minnesota to purchase the current STS enclosed trailer.

12. Approved the training requests from B. Rauenhorst to attend PACE Block Offering in Waite Park, and B. Douglas to attend an online Pro-West Experience Builder Training.

13. Directed the County Coordinator to work with staff to propose tax abatement policy language that reflects the original intent of the County Board.

14. Recessed the meeting to the Board of Appeal and Equalization meeting.

15. Approved payment of the following bills: Auditor warrants totaling $ 1,042,078.83; ACH-EFT payments totaling $ 1,036,985.83; and audit/auxiliary totaling $ 253,246.31.

Discussion was held concerning the following:

The proposed drainage project involves a petition for improvement to Judicial Ditch #4. This petitioned improvement contemplates enlarging tile diameters of the main tile in Faribault County, realignment of other tiles, abandonment of portions tile, the restoration of a wetland, and the use of separable maintenance. The project involves installation of approximately 145 linear feet of 6-inch tile, 1,864 linear feet of 8-inch tile, 1,831 linear feet of 10-inch tile, 895 linear feet of 12-inch tile, 33 linear feet of 15-inch tile, 408 linear feet of 18-inch tile, 3,890 linear feet of 24-inch tile, 2,200 linear feet of 36-inch tile, and a wetland restoration. The proposed project outlets into Judicial Ditch #2 in the northeast quarter of the northeast quarter of section 18 of Jo Daviess Township in Faribault County.

To the District Court above named the State of Minnesota brings this Petition and respectfully states and alleges:

I.

That Trunk Highway numbered 22, being Route numbered 39, and that Trunk Highway Legislative Route 255, which has been renumbered 109 have been located according to law and passes over the lands herein described.

That it is duly covered by Right of Way Plat Orders numbered 100762, 100828, 100751, 100750, 100757, 100793.

II.

That the Commissioner of Transportation deems it necessary that the State of Minnesota for trunk highway purposes obtain a temporary easement in the lands herein described and an easement as to Parcel 200, together with the following rights: to acquire all trees, shrubs, grass and herbage within the right of way herein to be taken, and to keep and have the exclusive control of the same.

Petitioner hereby moves the court for an order authorizing the Court Administrator to accept and deposit payments from the Petitioner to the court pursuant to Minn. Stat. § 117.042.

Petitioner hereby moves the court for an order transferring title and possession of the parcels herein described, prior to the filing of an award by the court appointed commissioners, pursuant to Minn. Stat. §117.042.

To the District Court above named the State of Minnesota brings this Petition and respectfully states and alleges:

I.

That Trunk Highway numbered 22, being Route numbered 39, and that Trunk Highway Legislative Route numbered 255, which has been renumbered 109, and which has been located according to law and passes over the lands herein described.

That it is duly covered by Right of Way Plat Orders numbered 100828, 100751, 100793, and 100794.

II.

That the Commissioner of Transportation deems it necessary that the State of Minnesota for trunk highway purposes obtain the lands herein described in fee simple absolute, together with the following rights:

to acquire all trees, shrubs, grass and herbage within the right of way herein to be taken, and to keep and have the exclusive control of the same and to acquire a temporary easement in those cases which are herein particularly mentioned.

Petitioner hereby moves the court for an order authorizing the Court Administrator to accept and deposit payments from the Petitioner to the court pursuant to Minn. Stat. § 117.042.

Petitioner hereby moves the court for an order transferring title and possession of the parcels herein described, prior to the filing of an award by the court appointed commissioners, pursuant to Minn. Stat. §117.042.

Further, Petitioner hereby moves the court for an order requiring the parties to exchange any appraisals at least 14 days prior to a commissioners’ hearing, pursuant to Minn. Stat. § 117.036.

The Petitioner reserves its right to recover costs of clean up and testing and all other damages arising from the presence of pollutants, contaminants, or hazardous materials on the property described herein, from all potential responsible parties, including respondents herein where appropriate, in a separate legal action to the extent permitted by law.
